<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13,1984 (VOL. 66) BY
<br />ZONING pEVIOUSLY UNZONED PROPERTY TO A ZONING DESIGNATION
<br />OF "PUD" (PLANNED UNIT DEVELOPMENT DISTRICT) SAME BEING
<br />0.489 ACRES, MORE OR LESS, OF LAND AREA IN THE J.M.
<br />VERAMENDI SURVEY, NO.2, BEING A PORTION OF THAT 0.50 ACRE
<br />TRACT CONVEYED BY SAN MARCOS INDUSTRIAL FOUNDATION TO C.C.
<br />HOLT, ET UX, BY DEED DATED SEPTEMBER 21,1978 AND RECORDED
<br />IN VOLUME 316, PAGE 380 OF THE HAYS COUNTY DEED RECORDS
<br />SAID 0.50 ACRE TRACT BEING A PORTION OF THAT 6.80 ACRE
<br />TRACT CONVEYED BY C.C. HOLT TO CHARLES D. NASH, JR. BY
<br />DEED DATED OCTOBER 15,1984 AND RECORDED IN VOLUME 475,
<br />PAGE 580 OF THE HAYS COUNTY REAL PROPERTY RECORDS; SAID
<br />TRACT BEING LOCATED ON THE WEST SIDE OF IH-35 NORTH AND
<br />ADJACENT TO BUTLER MANUFACTURING COMPANY; APPROVING THE
<br />GRANTING OF A PERMIT BY THE PLANNING COMMISSION FOR A
<br />PLANNED UNIT DEVELOPMENT ON SAID 0.489 ACRE TRACT;
<br />APPROVING A PLANNED UNIT DEVELOPMENT PLAN FOR SAID 0.489
<br />ACRE TRACT; AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on July 1,1986, the Zoning Commission of the City of San
<br />Marcos held a public hearing regarding a request to zone previously
<br />unzoned property to a zoning designation of "PUD" (Planned Unit
<br />Development District) said property being 0.489 acres of land in the
<br />J.M. Veramendi Survey, No.2, said tract being located in San Marcos,
<br />Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date said
<br />Commission did on July 1,1986, consider said request and the Zoning
<br />Commission voted to approve the same and has recommended that said
<br />request be approved by the City Council of said City~ and,
<br />

<br />WHEREAS, said City
<br />day of April
<br />
<br />Council held a public hearing on the
<br />, 1987, regarding said request; and,
<br />
<br />WHREAS, all requirements of Appendix A, General Zoning Ordinance
<br />of the Code of Ordinances of the City of San Marcos pertaining to
<br />amendments have been met; and,
<br />
<br />WHEREAS, Section F(2), Article V, Subdivision Ordinance, Appendix
<br />C of the Code of Ordinances of the City of San Marcos empowers the
<br />Planning Commission of the City of San Marcos to grant permits for
<br />Planned Unit Developments, subject to review and approval by the City
<br />Council; and,
<br />
<br />WHEREAS, on September 10, 1986, the Planning Commission of said
<br />City approved the granting of a permit for a Planned Unit Development
<br />on said 0.489 acre tract of land in the J.M. Veramendi Survey, No.2;
<br />and,
<br />
<br />WHEREAS, Section 34(C), General Zoning Ordinance, Appendix A of
<br />the Code of Ordinances of the City of San Marcos requires approval by
<br />the Zoning Commission of that City of San Marcos on a Planned Unit
<br />Development Plan; and,
<br />
<br />WHEREAS, on October 21,1986, said Zoning Commission approved a
<br />Planned Unit Development Plan for said 0.489 acre tract of land in the
<br />J.M. Veramendi Survey, No.2; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY

<br />SECTION 1. That the 0.489 acre tract of land area in the J.M.
<br />Veramendi Survey No.2, more particularly described by metes and bounds
<br />in Exhibit "A", which is attached hereto and incorporated herein for
<br />all purposes, which is presently unzoned henceforth shall be rezoned
<br />"PUD" (Planned Unit Development District).
