<br />-2- <br /> <br />WHEREAS, <br /> <br />all <br /> <br />the <br /> <br />territory <br /> <br />to be <br /> <br />included in <br /> <br />each <br /> <br />City's <br /> <br />jurisdiction <br /> <br />under <br /> <br />this <br /> <br />agreement <br /> <br />is <br /> <br />within <br /> <br />each <br /> <br />Ci ty I slaw fu 1 <br /> <br />extraterritorial jurisdiction; now, therefore, <br /> <br />FOR AND IN CONSIDERATION of the premises and the mutual <br /> <br />covenants <br /> <br />herein <br /> <br />contained <br /> <br />and <br /> <br />subject to the conditions herein set forth, the <br /> <br />parties <br /> <br />hereto <br /> <br />covenant, <br /> <br />agree <br /> <br />and <br /> <br />bind <br /> <br />themselves as <br /> <br />follows: <br /> <br />I. <br /> <br />That <br /> <br />the <br /> <br />City <br /> <br />of <br /> <br />San <br /> <br />Marcos <br /> <br />and <br /> <br />the <br /> <br />City <br /> <br />of Kyle agree to <br /> <br />establish <br /> <br />their <br /> <br />respective <br /> <br />City <br /> <br />limit and/or ETJ boundaries between <br /> <br />said cities along that line drawn from the Blanco River near the Robert <br /> <br />G. <br /> <br />Nance tract to <br /> <br />a point <br /> <br />near <br /> <br />the <br /> <br />Louis <br /> <br />Erlich/B. J. <br /> <br />Bishop <br /> <br />tract <br /> <br />as <br /> <br />shown <br /> <br />on <br /> <br />that certain map attached hereto and incorporated <br /> <br />herein for all purposes as Exhibit A. <br /> <br />II. <br /> <br />That <br /> <br />the <br /> <br />City of San Marcos and the City of Kyle accept and will <br /> <br />exercise the power of <br /> <br />subdivision <br /> <br />approval <br /> <br />under <br /> <br />the <br /> <br />au thori ty <br /> <br />of <br /> <br />Article <br /> <br />974a, <br /> <br />Vernon's <br /> <br />Texas <br /> <br />Civil <br /> <br />Statutes, <br /> <br />on all lands located <br /> <br />within <br /> <br />the <br /> <br />new <br /> <br />respective <br /> <br />contiguous City limits and <br /> <br />extraterritorial jurisdiction boundaries of each City. <br /> <br />III. <br /> <br />That <br /> <br />any <br /> <br />City <br /> <br />which <br /> <br />is a party to this Agreement which holds a <br /> <br />Certificate of Convenience and <br /> <br />Necessity <br /> <br />(CCN) <br /> <br />for <br /> <br />water <br /> <br />and/or <br /> <br />wastewater <br /> <br />service <br /> <br />in an area included in the jurisdiction of another <br /> <br />City which is a party to this Agreement shall use its best <br /> <br />efforts <br /> <br />to <br /> <br />effect <br /> <br />a trans fer <br /> <br />of <br /> <br />said <br /> <br />CCN <br /> <br />to the other City if requested to do <br /> <br />so in writing by the other City. <br /> <br />IV. <br /> <br />That <br /> <br />this <br /> <br />Ag reeme n t <br /> <br />shall <br /> <br />be <br /> <br />in <br /> <br />full <br /> <br />force <br /> <br />and <br /> <br />effect <br /> <br />in <br /> <br />perpetui ty <br /> <br />unless <br /> <br />cancelled, modified or amended by mutual consent of <br /> <br />the parties hereto. <br /> <br />V. <br /> <br />If any provision in this Agreement or any application hereof shall <br /> <br />be invalid, <br /> <br />illegal, or <br /> <br />unenforceable, <br /> <br />the <br /> <br />validity, <br /> <br />legality <br /> <br />and <br /> <br />enforceability <br /> <br />of the remaining <br /> <br />provisions and applications shall not <br /> <br />in any way be affected <br /> <br />or impaired thereby. <br />
