ç:::-" 111 ORDINANCE 1987-61 r'~ ~ """= ¿;: Al'1 rJRDINANCE OF THE CITY COUNCI L OF THE CITY OF SAN MARCOS, TEXAS, DECLARING THE PROPERTY ON WHICH THE OLD FISH HATCHERY BUILDING SITS AS PARKLAND AND ESTABLI SHING AN EFFECTI VE DATE. WHEREAS, the property on which the Old Fish Hatchery stands located in the J.M. Veramendi Survey was conveyed to the City of San Marcos by deed from the Urban Renewal Agency of the City of San Marcos dated November 6,1972 and recorded in Volume 256, Page 110 of the Hays County Deed Records; and, WHEREAS, the property has been used by the citizens of the City of San Marcos for park and recreational purposes; and, WHEREAS, the City Council and the citizens of the City desire use of the property to remain for park and recreation; now, therefore, BE IT ORDAINED BY THE CITY TEXAS: COUNCI L OF THE CITY OF SAN MARCOS, SECTION 1. That the parcel of land on which the Old Fish Hatchery building sits and which is more particularly described by the description below is hereby declared parkland: DESCRIPTION OF A SURVEY OF 1.25 ACRES, MORE OR LESS, OF LAND AREA IN THE J.M. VERAMENDI SURVEY, SAN MARCOS, HAYS COUNTY, TEXAS, BEING A PORTION OF THAT TRACT DESCRIBED AS "PARCEL lA-2B, 2.0296 ACRESII IN A DEED FRm1 THE URBAN RENEWAL AGENCY OF THE CITY OF SAN MARCOS TO THE CITY OF SAN MARCOS DATED NOVEMBER 6, 1972 AND RECORDED IN VOLUME 256, PAGE 110 OF THE HAYS COUNTY DEED RECORDS, BEING ALSO A PORTION OF HUTCHISON STREET (MOUNTAIN STREET) AS SHOWN ON THAT PLAT OF THE ORIGINAL TOWN OF SAN MARCOS RECORDED IN VOLUME 46, PAGE 448 OF THE HAYS COUNTY DEED RECORDS, AND BEING MORE PARTICUlARLY DESCRIBED BY METES AND BOUNDS AS FO LLOV\7S : COMMENCING at a concrete monument found in the north right-of-way line of R.M. Highway No. 12 and Hopkins Street at Engineers P.I. Station 64+14.93; THENCE with the north R.O.W. of R.M. Highway No. 12 and Hopkins Street N80° 36'OO"E 10.91 feet to a point at Engineers Station 64+28.96; THENCE leaving the original north line of Hopkins Street with the north line of R.M. Highway No. 12 the following two courses: 1. N09025'OO"W 24.15 feet to a point for the southwest corner of the aforereferenced City of San Marcos tract, and 2. With the common line of R.M. Highway No. 12 and the City of San Marcos tract N70049'OO"E 211.99 feet to an iron rod set for the southwest corner and PLACE OF BEGINNING of this tract; THENCE leaving R.M. Highway No. 12 and the PLACE OF BEGINNING crossing the City of San Marcos tract and Hutchison Street N09° 25'03"W 356.50 feet to an iron rod set in the north line of Hutchison Street for the northwest corner of this tract and the southwest corner of Lot 4, Block 28 of the Original Town of San Marcos as described in a deed from Hays County War Veterans, Inc. to the State of Texas dated June 30,1975 and recorded in Volume 276, page 620 of the Hays County Deed Records; THENCE with the common line of the State of Texas tract and Hutchison Street N80035'OO"E 161.66 feet to an iron rod set in the appoximate western gradient boundary of the San Marcos River for the northeast corner of this tract; THENCE leaving the State of Texas tract with the approximate western gradient boundary of the San Marcos River SOSo 31'4311E 329.59 feet to an iron rod set in the north line of R.M. Highway No. 12 for the southeast corner of the City of San Marcos tract and this tract; THENCE leaving the San Marcos River with the common line of R.M. Highway No. 12 and the City of San Marcos tract S70° 49'001lW
