<br />10. <br /> <br />11. <br /> <br />possession without charge, <br /> <br />of the airport or any portion <br /> <br />thereof during periods of National Emergency; <br /> <br />and further <br /> <br />subject to the right of the Federal Aviation Administration <br /> <br />and United states Government to take a portion of the airport <br /> <br />premises <br /> <br />air <br /> <br />for <br /> <br />traffic <br /> <br />activities, <br /> <br />control <br /> <br />weather <br /> <br />reporting activities, or communication activities related to <br /> <br />air traffic control, all as provided in said Indenture. <br />Construction of Improvements <br /> <br />All <br /> <br />improvements <br /> <br />on <br /> <br />the <br /> <br />alterations <br /> <br />and <br /> <br />made <br /> <br />by <br /> <br />Lessee <br /> <br />premises are subject to approval by Lessor in writing prior <br />to construction to determine that such construction is in <br /> <br />accordance with various applicable codes and ordinances and <br /> <br />the uses and purposes contemplated by this lease agreement, <br /> <br />and that the same will not constitute a fire or safety hazard <br /> <br />or interference in the use of the remainder of the Airport by <br /> <br />the general aviation public; <br /> <br />provided, <br /> <br />however, <br /> <br />that such <br /> <br />consent shall not be unreasonably withheld by Lessor. <br /> <br />No <br /> <br />mechanic's and materialman's lien shall be fixed against any <br /> <br />of the demised premises. <br /> <br />An operating facility as described <br /> <br />above will be completed within one (1) year of the execution <br /> <br />of this lease. <br /> <br />Insurance <br /> <br />Lessee shall, at its own expense, purchase, maintain and keep <br /> <br />in force such insurance as will protect Lessee from claims <br /> <br />set forth below which may arise out of or result from any <br /> <br />operations at the San Marcos Municipal Airport, whether such <br /> <br />operations be by Lessee or by any subcontractor or by anyone <br />directly or indirectly employed by Lessee or by anyone for <br /> <br />whose acts Lessee or any subcontractor may be liable: <br /> <br />A. <br /> <br />Such insurance as will protect Lessee from claims under <br /> <br />statutory Workmen's compensation laws, <br /> <br />disability laws <br /> <br />or <br /> <br />such <br /> <br />other <br /> <br />employee <br /> <br />benefit <br /> <br />laws <br /> <br />will <br /> <br />fulfill <br /> <br />the <br /> <br />as <br /> <br />requirements of the jurisdiction in which the work is to be <br /> <br />performed. <br /> <br />insurance <br /> <br />Such <br /> <br />will <br /> <br />be <br /> <br />amended <br /> <br />to provide <br /> <br />-6- <br />
