Best Company, or insurance carriers having <br />a rating lower than B+VII as shown in the most recent edition <br /> <br />of said book, <br /> <br />will not be approved by the ci ty unless a <br /> <br />guaranty bond acceptable to said City from a carrier rated <br /> <br />B+VII or higher guaranteeing payment of any and all claims <br /> <br />against Lessee is furnished to the City. <br /> <br />All insurance required under this Paragraph 11. shall be <br /> <br />written <br /> <br />with <br /> <br />City <br /> <br />the <br /> <br />of <br /> <br />San <br /> <br />Marcos <br /> <br />an <br /> <br />additional <br /> <br />as <br /> <br />insured. <br /> <br />The stated limits of insurance required by this <br /> <br />Paragraph 11. are MINIMUM <br /> <br />it <br /> <br />ONLY <br /> <br />and <br /> <br />shall <br /> <br />be <br /> <br />Lesseets <br /> <br />responsibility to determine what limits are adequate. <br /> <br />These <br /> <br />minimum limits may be basic policy limits or any combination <br /> <br />of basic limits and umbrella limits. <br /> <br />In any event, Lessee is <br /> <br />fully responsible for all losses arising out of, <br /> <br />resulting <br /> <br />from <br /> <br />with <br /> <br />connected <br /> <br />operations <br /> <br />or <br /> <br />under <br /> <br />this <br /> <br />Agreement <br /> <br />whether or not said losses are covered by insurance. <br /> <br />The <br /> <br />City's acceptance of Certificates of Insurance that in any <br />respect do not comply with the Agreement requirements does <br /> <br />not release Lessee from compliance herewith. <br /> <br />All insurance required under this Paragraph 11. shall be <br /> <br />primary over any other insurance coverage the City of San <br /> <br />Marcos may have. <br /> <br />Indemnity And Hold Harmless. <br /> <br />A. <br /> <br />Lessee shall indemnify Lessor and save it harmless from <br /> <br />suits, actions, damages, liability and expense in connection <br /> <br />with the loss of life, bodily or personal injury or property <br /> <br />damage arising from or out of any occurrence in or upon the <br />demised premises or from the occupancy or the use by Lessee <br /> <br />of said premises or any part thereof, or occasioned wholly or <br /> <br />in part <br /> <br />by <br /> <br />omission <br /> <br />act <br /> <br />its <br /> <br />of <br /> <br />any <br /> <br />Lessee, <br /> <br />agents, <br /> <br />or <br /> <br />contractors, <br /> <br />employees, <br /> <br />invitees, <br /> <br />servants, <br /> <br />licensees <br /> <br />or <br /> <br />-8- <br />
