<br />THE STATE OF TEXAS <br /> <br />USE AGREEMENT <br /> <br />COUNTY OF HAYS <br /> <br />KNOW ALL PERSONS BY THESE PRESENTS: <br /> <br />That the City of San Marcos, Texas, (City) a municipal corporation <br /> <br />existing <br /> <br />by and under the laws of the State of Texas, situated in Hays <br /> <br />County, acting through authority conferred on its Mayor, J.E. <br /> <br />Younger, <br /> <br />by <br /> <br />resolution <br /> <br />duly <br /> <br />enacted <br /> <br />on <br /> <br />April 27, 1987 <br /> <br />, and the San <br /> <br />Marcos Radio Control Association, or its <br /> <br />successor, <br /> <br />acting <br /> <br />through <br /> <br />its <br /> <br />president, <br /> <br />J. D. Oliver, Jr. <br /> <br />, <br /> <br />("Clubll) <br /> <br />enter into this <br /> <br />agreement upon the following terms and conditions: <br /> <br />I. <br /> <br />For <br /> <br />and <br /> <br />in <br /> <br />consideration <br /> <br />of <br /> <br />the <br /> <br />use by Club of a section <br /> <br />of <br /> <br />Lowman <br /> <br />Airport, the specific area of which <br /> <br />shall be <br /> <br />subject to <br /> <br />City <br /> <br />approval, <br /> <br />loca ted <br /> <br />within <br /> <br />the <br /> <br />corporate <br /> <br />limits <br /> <br />of <br /> <br />the Ci ty of San <br /> <br />Marcos, Club agrees to strictly comply with its duties and <br /> <br />obI ig a tions <br /> <br />assumed hereunder. <br /> <br />II. <br /> <br />The <br /> <br />use <br /> <br />by <br /> <br />Club of the Lowman Airport shall be so long as the <br /> <br />Agreement is effective. <br /> <br />This Agreement shall take effect upon <br /> <br />passage <br /> <br />of <br /> <br />a Resolution adopting same, upon execution by the parties, and upon <br /> <br />compliance with insurance <br /> <br />provisions <br /> <br />herein. <br /> <br />This <br /> <br />Ag reemen t <br /> <br />shall <br /> <br />terminate <br /> <br />immediately <br /> <br />upon <br /> <br />notice <br /> <br />from <br /> <br />either <br /> <br />party <br /> <br />to the other <br /> <br />indicating <br /> <br />intent to so terminate. <br /> <br />In <br /> <br />the <br /> <br />event ownership of Lowman <br /> <br />Airport is changed, <br /> <br />this <br /> <br />Agreement shall terminate <br /> <br />immediately <br /> <br />upon <br /> <br />notification to Club. <br />
