<br />123 <br /> <br />RESOLUTION 1987-50R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, DESIGNATING A <br />REPRESENTATIVE OF THE CITY PURSUANT TO THE <br />OPERATING AGREEMENT \VITH THE LOWER COLORADO <br />RIVER AUTHORITY, AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, the City of San Marcos and the Lmver Colorado <br />River Authority have entered into an Operating Agreement <br />dated July 24, 1986: and <br /> <br />WHEREAS, said Operating Agreement provides in Section <br />4.4 that the City of San Marcos shall designate a person who <br />shall serve as Representative of the City in all matters <br />pertaining to this Agreement; and <br /> <br />WHEREAS, the City Council of San Marcos wishes to act in <br />such a manner as to discharge its responsibilities with <br />respect to said Operating Agreement~ now, therefore~ <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />HARCOS, TEXAS: <br /> <br />PART 1. That the City Manager of the City of San <br />Marcos, A. C. Gonzalez, be and hereby is designated as the <br />Representative of the City of San Marcos (City) in all <br />matters pertaining to the Operating Agreement with the Lower <br />Colorado River Authority (LCRA) dated July 24, 1986. <br /> <br />PART 2. That the City Manager is hereby authorized to <br />act as the official representative in communications between <br />LCRA and the City. <br /> <br />PART 3. That LCRA may rely on written directions of <br />the City Manager in any action taken by LCRA under said <br />Agreement. <br /> <br />PART 4. That unless the City Council shall hereafter <br />act otherwise by formal resolution with copies provided to <br />LCRA, successors in office to A.C. Gonzalez as City Manager <br />shall be hereafter designated as the official representative <br />of the City in accordance with Section 4.4 of said Operating <br />Agreement, with written notice to LCRA by the Mayor of said <br />City that a successor in office has been do designated by the <br />City Council. <br /> <br />PART 5. That the City Manager is hereby authorized and <br />directed to provide a certified copy of this Resolution upon <br />execution to LCRA. <br /> <br />PART 6.
