62. <br /> <br /> Attachment 2 <br />Terms and Conditions of the Prime Award and Other Special Terms and Conditions <br /> <br />This Agreement is made as a result of the Governor's Criminal Justice Division (CJD) Grant No. DB-01-AI0- <br />16386-02, "Advanced Law Enforcement Rapid Response Training", that was awarded to University. This <br />project is subject to and conditioned upon acceptance of the Governor's Criminal Justice Division's rules in Title <br />1, Part 1, Chapter 3, Texas Administrative Code. Collaborator agrees to abide by these provisions, including <br />the appropriate administrative and cost guidelines. Where approval is required from CJD, such approval shall <br />be sought from University. <br /> <br />Terms and Conditions <br /> <br />The restrictions on the expenditure of federal funds in appropriations acts are applicable to this subaward to <br />the extent those restrictions are pertinent. <br /> <br />The Collaborator agrees to comply with the financial and administrative requirements set forth in the <br />effective edition of the "OJP Financial Guide." <br /> <br />3. The Collaborator agrees to comply with the Uniform Grant Management Standards (UGMS) which can be <br /> found at http://www, govemor, state.tx:us. <br /> <br />The Collaborator acknowledges that failure to submit an acceptable Equal Employment Opportunity Plan (if <br />the Collaborator is required to submit one pursuant to 28 CFR 42.302), that is approved by the Office for <br />Civil Rights, is a violation of its Certified Assurances and may result in the suspension of the drawdown of <br />funds. <br /> <br />5. The Collaborator agrees to comply with the requirements of 28 CFR Part 46 regarding the protection of <br /> human research subjects, including obtainment of Institutional Review Board approval, if appropriate. <br /> <br />6. The Collaborator agrees to comply with all confidentiality requirements of 42 U.S.C. Section 3789g and 28 <br /> CFR Part 22 that are applicable to the collection, use and revelation of data or information. <br /> <br />Compliance Assurances and Certifications. Collaborator certifies, by signing this document that the <br />following assurances and certifications that apply to the University's prime grant are met. Such assurances and <br />certifications required by the Collaborator shall include but are not necessarily limited to: <br /> <br />Civil Rights. Compliance with Title VI of the Civil Rights Act of 1964. <br /> <br />Handicapped Individuals. Compliance with Section 504 of the Rehabilitation Act of <br />1973 as amended. <br /> <br />Sex Discrimination. Compliance with Section 901 of Title D (of the Education <br />Amendments of 1972 as amended). <br /> <br />Age Discrimination. Compliance with the Age Discrimination Act of 1975 as amended. <br /> <br />Patents, Licenses, and Inventions. Compliance with the Standard Patent Rights clauses as specified <br />in 37 CFR, Part 501, FAR 57.227-11, or U.S.C. 203, whichever is appropriate and applicable. <br /> <br />Non-Delinquency on Federal Debt. Collaborator specifically certifies that neither it nor any person to <br />be paid from funds under this Agreement is delinquent in repaying any Federal debit as defined by OMB <br />Circular A-129. <br /> <br />Drug-Free Workplace. Compliance with the Drug-Free Workplace Act of 1988, 45 <br />CFR Part 76, Subpart F. <br /> <br />Misconduct in Science. Compliance with 42 CFR Part 50, Subpart A, and Final Rule as published at <br />54 CFR 32446, August 8, 1989. <br /> <br /> <br />
