<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE ~mICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING LOTS 1,3,4,5,6,7 AND 8 OF THE RESUBDIVISION
<br />OF BLOCK 17 OF THE WESTOVER ADDITION TO THE CITY OF SAN
<br />MARCOS AS RECORDED IN VOLUME 1, PAGE 195 OF THE HAYS
<br />COUNTY PLAT RECORDS; LOCATED NORTHWEST OF THE 1000
<br />BLOCK OF EARLE STREET AND SOUTHWEST OF THE 1200 BLOCK
<br />OF GIRARD STREET FROM "DP-2" (DUPLEX DISTRICT- MEDIUM
<br />DENSITY) AND "R-l" (SINGLE FAMILY DWELLING DISTRICT- LOW
<br />DENSITY) TO "DP-l" (DUPLEX DISTRICT-LOW DENSITY); AND
<br />DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on March 3, 1987, the Zoning Commission of the City of
<br />San Marcos held a public hearing regarding a request to change
<br />the zoning from "DP-2" (Duplex District-Medium Density) and
<br />"R-l" (Single Family Dwelling District-Low Density) to "DP-l" (Duplex
<br />District-Low Density) of Lots 1, 3, 4, 5, 6, 7 and 8 of the
<br />Resubdivision of Block 17 of the Westover Addition to the City of San
<br />Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on March 3,1987, consider said request and
<br />voted to approve the same and has recommended that such request be
<br />approved by the City Council of said City; and,
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />May, 1987, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real
<br />located in San Marcos, Hays County, Texas, which is
<br />zoned "DP-2" (Duplex District-Medium Density) and "R-l"
<br />Family Dwelling District- Low Densi ty) be rezoned "DP-l"
<br />District-Low Density):

<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on May 27, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.
<br />
<br />PASSED, APPROVED AND ADOPTED this 11 day of May, 1987,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for May 27, 1987
