<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, ~1ENDING SECTION 3 OF THAT ORDINANCE
<br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF
<br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13,1984 (VOL.
<br />66) BY ZONING TRACT D OF THE REVISED PLAT OF S.A.
<br />MAJOR'S SUBDIVISION NO.1 OUT OF THE J.M. VERAMENDI
<br />LEAGUE NO.2 RECORDED IN VOLUME 141, PAGE 609 OF THE
<br />HAYS COUNTY DEED RECORDS A/K/A 2115 AND 2117 RIVER ROAD
<br />FROM "PD" (PRE-DEVELOPMENT DISTRICT) TO "R-1"
<br />(SINGLE-FAf\HLY DWELLING DISTRICT....LOW DENSITY) AND
<br />DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on February 17,1987, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to
<br />change the zoning from "PD" (Pre-Development District)
<br />to "R-1" (Single Family Dwelling District-Low Density) of Tract
<br />D of the revised plat of S.A. Major's Subdivision No.1 out of
<br />the J.M. Veramendi League No.2 to the City of San Marcos, Hays
<br />County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on February 17,1987, consider said request and
<br />voted to approve the same and has recommended that such request be
<br />approved by the City Council of said City; and,
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />May, 1987, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following tract of real property located in
<br />San Marcos, Hays County, Texas, which was classified "PD"
<br />(Pre-Development District) upon its annexation to the City of San
<br />Marcos on November 24, 1980, henceforth shall be zoned as "R-1"
<br />(Single Family Dwelling District-Low Density):
<br />
<br />ZONING TRACT D OF THE REVISED PLAT OF S.A. MAJOR'S
<br />SUBDIVISION NO.1 OUT OF THE J.M. VERM1ENDI LEAGUE NO.2
<br />RECORDED IN VOLUME 141, PAGE 609 OF THE HAYS COUNTY DEED
<br />RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on May 27, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this 11 day of May , 1987,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for May 27, 1987
