<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13,1984 (VOL. 66) BY
<br />ZONING BLOCK 45, LOTS 573-576 OF THE WESTOVER ADDITION
<br />TO THE CITY OF SAN MARCOS AS RECORDED IN VOLUME 59, PAGE
<br />185 OF THE HAYS COUNTY DEED RECORDS; LOCATED ON THE
<br />SOUTHEAST SIDE OF THE 800 BLOCK OF HILLYER STREET FROM
<br />"DP-2" (DUPLEX DISTRICT-MEDIUM DENSITY TO "R-l" (SINGLE
<br />FAMILY DWELLING DISTRICT-LOW DENSITY) ; AND DECLARING AN
<br />EFFECTIVE DATE.
<br />
<br />WHEREAS, on March 3, 1987, the Zon ing Commiss ion of the Ci ty of
<br />San Marcos held a public hearing regarding a request to change
<br />the zoning from "DP-2" (Duplex District-Medium Density) to
<br />"R-l" (Single Family Dwelling District-Low Density) of Block 45, Lots
<br />573-576 of the Westover Addition to the City of San Marcos, Hays
<br />County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on March 3,1987, consider said request and
<br />voted to approve the same and has recommended that such request be
<br />approved by the City Council of said City; and,
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />May, 1987, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />zoned "DP-2" (Duplex District-Medium Density) be rezoned "R-l"
<br />Single Family Dwelling District-Low Density):
<br />
<br />BLOCK 45, LOTS 573-576 OF THE WESTOVER ADDITION TO THE CITY OF
<br />SAN MARCOS AS RECORDED IN VOLUME 59, PAGE 185 OF THE HAYS
<br />COUNTY DEED RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on May 27, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this 11 day of May, 1987,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for May 27, 1987 .
