<br /> <br /> <br /> <br />22 <br /> <br />ORDINANCE 1987-70 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 10 OF THE SAN MARCOS <br />CODE OF ORDINANCES BY REPEALING THE 1976 FIRE <br />PREVENTION CODE AND ADOPTING THE 1985 STANDARD FIRE <br />PREVENTION CODE AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />BE <br /> <br />IT <br /> <br />ORDAINED <br /> <br />BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That Section 10-38 of the San Marcos Code <br />Ordinances is repealed and the following is adopted in its place: <br /> <br />of <br /> <br />Sec. 10-38. <br /> <br />Adopted. <br /> <br />The Standard Fire Prevention Code, 1985 Edition published by <br />the Southern Building Code Congress International, Inc.; 900 <br />Montclair Road; Birmingham, Alabama 35213-1206 is adopted and <br />shall control within the corporate limits of the City of San <br />Marcos and in its extraterritorial jurisdiction to the extent <br />allowed by law. A copy of the Code is on file in the <br />Office of the City Secretary. <br /> <br />SECTION 2. That Section 10-39(c) is repealed <br />is adopted in its place: <br /> <br />and <br /> <br />the <br /> <br />following <br /> <br />All violations of this Code are declared nuisances and are <br />prohibited within the City limits and outside the City limits <br />for a distance of 5000 feet. <br /> <br />SECTION 3. That <br />adopted in its place: <br /> <br />Section 10-40 is repealed and the following is <br /> <br />Sec. 10-40. <br /> <br />De fin it ions. <br /> <br />a. <br /> <br />"Applicable Governing body means the City <br />City of San Marcos. <br /> <br />Council'of <br /> <br />the <br /> <br />b. <br /> <br />"Chief of <br />l\1arshall <br /> <br />the <br /> <br />Fire <br /> <br />Prevention <br /> <br />Bureau" means the <br /> <br />Fire <br /> <br />c. <br /> <br />"Fire Department" means the San Marcos Fire Department. <br /> <br />d. <br /> <br />"Fire Official" means the Fire Marshall. <br /> <br />e. <br /> <br />"Fire Prevention <br />Department. <br /> <br />Bureau" <br /> <br />means <br /> <br />the <br /> <br />San <br /> <br />Marcos <br /> <br />Fire <br /> <br />f. <br /> <br />"Board of Appeals" means the Zoning Board of <br />and Appeals. <br /> <br />Adjustments <br /> <br />g. <br /> <br />"Jurisdiction" and "jurisdictional area" means the City of <br />San Marcos and its extraterritorial jurisdiction to the <br />extent allowed by law. <br /> <br />SECTION 4. <br /> <br />That Section 10-41 and Section 10-46 are repealed. <br /> <br />SECTION 5.
