32 RESOLUTION 1987- 60R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT REGARDING WASTEwATER IMPROVEMENTS WITH SAN MARCOS NORTH JOINT VENTURE, AUTHORIZING THE CITY MANAGER TO EXECUTE SAID AGREEMENT, AND DECLARING AN I:FFECTIVE DATE. WHEREAS, on May 19, 1986, a Community Facilities Agreement was made and entered into between said City, S B & K Joint Venture I a Texas joint venture, Joe K. Dobie and wife, Daisy Dobie, Ed Salinas and John Rochford Joint Venture, a Texas joint venture, Rakor, Inc., a Texas corporation, and Guy Shown Company and River Ridge Joint Venture, a Texas general partnership: and, WHEREAS, said City wishes to enter into an agreement regarding wastewater improvements with San Marcos North Joint Venture in order to secure an easement needed to complete the aforesaid Community Facilities Agreement project: and, \'lHEREAS, San Marcos North Joint Venture has agreed to supply the City an easement and other good and value consideration for the agreement regarding wastewater improvements; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the terms and conditions contained in that Agreement regarding wastewater improvements I a copy of which is attached hereto and incorporated herein for all purposes, are hereby approved. PART 2. That the City Manager is hereby authorized to execute said Agreement on behal f of the City of San Marcos, Texas. PART 3.
