<br />-2- <br /> <br />for <br /> <br />the <br /> <br />purpose <br /> <br />of <br /> <br />enabling <br /> <br />Grantee <br /> <br />to lay, construct, <br /> <br />reconstruct and <br /> <br />maintain and to have laid, constructed, <br /> <br />reconstructed <br /> <br />and <br /> <br />maintained, <br /> <br />drainage, <br /> <br />wa ter, <br /> <br />and <br /> <br />electric <br /> <br />pipes and/or lines <br /> <br />along, across, through, under <br /> <br />and over <br /> <br />said <br /> <br />easement, <br /> <br />and <br /> <br />for <br /> <br />the <br /> <br />purpose <br /> <br />of <br /> <br />enabling <br /> <br />Grantee to <br /> <br />maintain <br /> <br />and to <br /> <br />have <br /> <br />maintained <br /> <br />wastewater <br /> <br />pipes <br /> <br />and/or <br /> <br />lines along, across, through, under and over <br /> <br />said <br /> <br />easement, and Grantor <br /> <br />shall at all times keep the surface of the <br /> <br />above-described <br /> <br />easement <br /> <br />premises <br /> <br />clear, <br /> <br />unobstructed <br /> <br />and <br /> <br />completely accessible to facilitate <br /> <br />Grantee's <br /> <br />maintenance <br /> <br />of <br /> <br />said <br /> <br />wastewater <br /> <br />pipes <br /> <br />and/or lines. <br /> <br />The <br /> <br />easement <br /> <br />herein <br /> <br />granted <br /> <br />and <br /> <br />conveyed <br /> <br />for <br /> <br />drainage, <br /> <br />water, wastewater and <br /> <br />electricity is <br /> <br />in tended to <br /> <br />be, <br /> <br />and <br /> <br />shall <br /> <br />be <br /> <br />construed <br /> <br />as <br /> <br />a covenant <br /> <br />running with the land, binding upon the land <br /> <br />above <br /> <br />described, <br /> <br />and <br /> <br />to the present and successive owners thereof, <br /> <br />and inuring to <br /> <br />the <br /> <br />benefit of <br /> <br />the <br /> <br />general <br /> <br />publ ic <br /> <br />having <br /> <br />occasion <br /> <br />to <br /> <br />use <br /> <br />the <br /> <br />drainage, <br /> <br />water, <br /> <br />wastewater <br /> <br />and <br /> <br />electric systems of <br /> <br />Grantee. <br /> <br />TO <br /> <br />HAVE <br /> <br />AND TO HOLD the said easement, together <br /> <br />with all of the <br /> <br />rights herein granted, unto said Grantee, its successors <br /> <br />and <br /> <br />assigns, <br /> <br />as <br /> <br />long as the same shall be useful for the ~urposes of and desired by <br /> <br />said Grantee, its successors and assigns, and Grantor binds itself, its <br /> <br />successors <br /> <br />and assigns, to warrant and forever defend all and singular <br /> <br />said <br /> <br />premises unto the Grantee, its successors <br /> <br />and <br /> <br />assigns, <br /> <br />against <br /> <br />every <br /> <br />person <br /> <br />whomsoever lawfully claiming or to claim the same or any <br /> <br />part thereof. <br /> <br />SAN MARCOS NORTH JOI NT VENTURE <br />GRANTOR <br /> <br />David J.
