<br />-7- <br /> <br />13. <br /> <br />Condemnat~on. <br /> <br />a. <br /> <br />Total: <br /> <br />If the the dem~sed prem~ses shall be acquired or <br /> <br />taken bY em~nent doma~n for any public or quasi-public use or <br /> <br />purpose, then th~s lease and the term herein shall cease <br /> <br />and <br /> <br />terminate as of the date of title vest~ng in such proceeding. <br /> <br />b. <br /> <br />Part~al.: <br /> <br />If any part of the dem~sea premises or all. or <br /> <br />part of the San Marcos Munic1pal Airport shall <br /> <br />De <br /> <br />taken <br /> <br />as <br /> <br />aforesaid, <br /> <br />and such partial tak~ng shall render that port10n <br /> <br />of the aem1sed prem~ses <br /> <br />not <br /> <br />so <br /> <br />taken <br /> <br />unsu1tabl.e <br /> <br />for <br /> <br />the <br /> <br />business of Lessee, then th1S l.ease ana the term here1n shall <br /> <br />cease <br /> <br />ana terminate as aforesaia. <br /> <br />If such part1al tak1ng is <br /> <br />not extens1ve enough to render the <br /> <br />premises <br /> <br />unsuitable <br /> <br />for <br /> <br />the <br /> <br />business <br /> <br />of <br /> <br />Lessee, <br /> <br />then this lease shall. continue 1n <br /> <br />effect except that the minimum rental shall <br /> <br />be <br /> <br />reduced <br /> <br />and <br /> <br />adJusted in an appropriate manner. <br /> <br />c. <br /> <br />If <br /> <br />this <br /> <br />lease <br /> <br />is <br /> <br />terminated <br /> <br />as <br /> <br />provided <br /> <br />1n <br /> <br />this <br /> <br />paragraph, rent shall be pa1d up to the date that <br /> <br />possess10n <br /> <br />is <br /> <br />so <br /> <br />taken <br /> <br />DY <br /> <br />PUD11C authority, ana Lessor shall make an <br /> <br />equitable refund of any rent pa1d bY Lessee in advance. <br /> <br />d. <br /> <br />Awara: <br /> <br />Lessee shall not be entitled <br /> <br />to <br /> <br />ana <br /> <br />expressly <br /> <br />wa1ves <br /> <br />all <br /> <br />cJ.a1m <br /> <br />to any condemnation awara for any taking, <br /> <br />whether whole or part1al, and whether for d1minution in value <br /> <br />of the leasehold or to the fee <br /> <br />although <br /> <br />Lessee <br /> <br />shall <br /> <br />have <br /> <br />ther1ght, <br /> <br />to <br /> <br />the <br /> <br />extent <br /> <br />that <br /> <br />the <br /> <br />same <br /> <br />shall not reduce <br /> <br />Lessor's award, to cla1m from the <br /> <br />condemnor, <br /> <br />but <br /> <br />not <br /> <br />from <br /> <br />Lessor, <br /> <br />such compensation as may be recoverable by Lessee 1n <br /> <br />its own right for damage to Lessee's Dusiness and fixtures. <br /> <br />14. <br /> <br />Operation of the Airport. <br /> <br />a. <br /> <br />Lessor reserves the right <br /> <br />to <br /> <br />operate <br /> <br />the <br /> <br />Airport <br /> <br />in <br /> <br />accordance <br /> <br />W1th <br /> <br />the <br /> <br />Obi jgAt1nn <br /> <br />to <br /> <br />the <br /> <br />F'f'!aeral <br /> <br />or State <br /> <br />Government under any of the <br /> <br />agreements <br /> <br />for <br /> <br />whJ.ch <br /> <br />a1d <br /> <br />for <br /> <br />development was granted; provided, however, 1f such operat10n <br /> <br />restricts <br /> <br />the <br /> <br />operat10n <br /> <br />of Lessee on the dem1sed premises, <br /> <br />appropr1ate rental reductions shall De <br /> <br />negotiated. <br /> <br />In <br /> <br />the <br /> <br />event that appropriate rental reductions cannot be negotiated <br /> <br />between <br /> <br />the <br /> <br />partJ.es <br /> <br />hereto, then 1n such event, this lease <br /> <br />shall terminate and the parties hereto shall have no further <br />
