<br />56 <br /> <br />STATE OF TEXAS <br /> <br />LEASE ADDENDUM NUMBER ONE <br /> <br />COUNTY OF CALDWELL <br /> <br />KNOW ALL PERSONS BY THESE PRESENTS THAT: <br /> <br />The <br /> <br />City <br /> <br />of <br /> <br />San <br /> <br />Marcos, <br /> <br />Texas, <br /> <br />a <br /> <br />municipal <br /> <br />corporation <br /> <br />organized <br /> <br />and existing <br /> <br />under <br /> <br />the <br /> <br />laws <br /> <br />of <br /> <br />the <br /> <br />State <br /> <br />of <br /> <br />Texas, <br /> <br />acting <br /> <br />under <br /> <br />authority <br /> <br />conferred <br /> <br />on <br /> <br />its <br /> <br />Mayor, <br /> <br />J.E. <br /> <br />Younger, <br /> <br />hereinafter <br /> <br />re ferred <br /> <br />to <br /> <br />as <br /> <br />"Lessor" <br /> <br />and <br /> <br />John <br /> <br />J. <br /> <br />Stokes, <br /> <br />Sr., <br /> <br />hereinafter referred to as "Lessee", do hereby agree and contract <br /> <br />to add the following provision as a substitute for article 3 and <br /> <br />to add other provisions as <br /> <br />follows to article 14 of the lease <br /> <br />agreement <br /> <br />adopted <br /> <br />on <br /> <br />July <br /> <br />28, <br /> <br />1986 <br /> <br />and <br /> <br />modified <br /> <br />by <br /> <br />the <br /> <br />City <br /> <br />Council of the City of San Marcos on August 25, 1986, to reflect a <br /> <br />new term, <br /> <br />which <br /> <br />shall <br /> <br />remain <br /> <br />in <br /> <br />full <br /> <br />force <br /> <br />and <br /> <br />effect, <br /> <br />said <br /> <br />agreement being attached hereto as "Exhibit A" and incorporated by <br /> <br />reference herein for all purposes: <br /> <br />3. <br /> <br />Term of Lease. <br /> <br />The primary term of this <br /> <br />lease <br /> <br />for the property <br /> <br />heretofore described in paragraph 1 shall be for a term <br /> <br />of twenty (20) years beginning the 1st day of September, <br /> <br />1986, and running through the 31st day of August, 2006. <br /> <br />Lessee, if not in default shall have the option of <br />renewing this lease two (2) additional five (5) year <br />periods. The lease payment for each five (5) year <br /> <br />period shall be calculated as detailed in paragraph four <br /> <br />(4) and five (5) herein. <br /> <br />. . . <br /> <br />14. <br /> <br />Operations of the Airport. <br /> <br />. . . <br /> <br />o. <br /> <br />The right to conduct aeronautical activities <br /> <br />for <br /> <br />furnishing services to the public <br /> <br />is granted the <br /> <br />Lessee subject to Lessee agreeing: <br /> <br />(1 ) <br /> <br />to furnish said services on a fair, equal <br /> <br />and <br /> <br />not <br /> <br />unjustly <br /> <br />discriminatory <br /> <br />basis <br /> <br />to <br /> <br />all <br /> <br />users <br /> <br />thereof, and <br /> <br />-1- <br />
