<br /> <br /> <br /> <br />71 <br /> <br />ORDINANCE 1987-75 <br /> <br />AN OPDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, N1ENDING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, <br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY <br />ZONING BLOCKS 1,2 AND 11, VICTORY GARDENS SECTION 1 AS <br />RECORDED IN VOLUME 128, PAGE 46 OF HAYS COUNTY DEED <br />RECORDS AND 0.85 OF AN ACRE OF LAND WITHIN THE J.M. <br />VERAMENDI SURVEY NUMBER ONE, CITY OF SAN MARCOS, HAYS <br />COUNTY, TEXAS, SAID 0.85 OF ONE ACRE BEING A PORTION OF <br />THAT CERTAIN 20 ACRE TRACT DESCRIBED IN VOLUME 127, PAGE <br />399 OF THE DEED RECORDS OF HAYS COUNTY,TEXAS, LOCATED AT <br />COMACHO STREET, TRUMAN STREET AND HULL STREET FROM "I" <br />(INDUSTRIAL DISTRICT) TO "R-2 (SINGLE FAMI LY DWELLING <br />DISTRICT- MEDIUM DENSITY); AND DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, on January 20,1987, the Zoning Commission of the City <br />of San Marcos held a public hearing regarding a request to change <br />the zoning from "I" (Industrial) to IR-2" (Single Family Dwelling <br />District-Medium Density) of Blocks 1,2 and 11, Victory Gardens Section <br />1 and 0.85 of an acre of land within the J.M. Veramendi League Survey <br />Number One to the City of San Marcos, Hays County, Texas; and, <br /> <br />WHEREAS, subsequent to said public hearing on said date, said <br />Commission did, on January 20,1987, consider said request <br />and voted to approve the same and has recommended that such request <br />be approved by the City Council of said City; and, <br /> <br />of <br /> <br />WHEREAS, said City Council held a public hearing on the <br />June, 1987, regarding such request; and, <br /> <br />8 <br /> <br />day <br /> <br />WHEREAS, all requirements of Appendix A, General Zoning <br />Ordinance, of the Code of Ordinances of the City of San Marcos <br />pertaining to amendments have been met; and, <br /> <br />WHEREAS, said City Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the public <br />health, morals, welfare and safety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />TEXAS: <br /> <br />SECTION 1. That the following described tract of real property <br />located in San Marcos, Hays County, Texas, which is presently <br />"I" (Industrial District) be rezoned "R-2" (Single Family Dwelling <br />District-Medium Density): <br /> <br />BLOCKS 1,2 and 11, VICTORY GARDENS, SECTION 1 AS RECORDED IN <br />VOLUME 128, PAGE 46 OF HAYS COUNTY DEED RECORDS AND 0.85 ACRES. <br /> <br />A ZONING DESCRIPTION, PREPARED FROM PUBLIC RECORD AND <br />CALCULATIONS BASED ON PUBLIC RECORD, OF 0.85 OF ONE ACRE OF LAND <br />WITHIN THE J.M. VERAMENDI SURVEY NUMBER ONE, CITY OF SAN MARCOS, <br />HAYS COUNTY, TEXAS, SAID 0.85 OF ONE ACRE BEING A PORTION OF <br />THAT CERTAIN 20 ACRE TRACT DESCRIBED IN VOLUME 127, PAGE 399 OF <br />THE DEED RECORDS OF HAYS COUNTY, TEXAS, SAID 0.85 OF ONE ACRE <br />DELINEATED ON ATTACHED SKETCH AS "TRACT ONE" AND BEING MORE <br />PARTICULARLY DESCRIBED AS FOLLOWS: <br /> <br />BEGINNING at the most westerly corner of Lot 1, Block 11, First <br />Section of Victory Gardens, a subdivision recorded in Volume <br />128, Page 46 of the Deed Records of Hays County, Texas, same <br />being the most northerly corner of Lot 8, Block 15 of said First <br />Section of Victory Gardens and the northeast line of an <br />undedicated tract of land commonly known as Truman Street; <br /> <br />THENCE along said northeast line of said Truman Street, North 45 <br />degrees 24'30" West a distance of 339.4 feet to the northwest <br />line of said 20 acre tract, same being the southeast line of the <br />MKT Railroad right-of-way; <br /> <br />THENCE along said northwest and said southeast lines, North 34 <br />degrees 40' East a distance of 106.5 feet to an exterior corner <br />of said 20 acre tract; <br /> <br />THENCE along said northwest line, South 46 degrees 04' East a <br />distance of 356.2 feet to an interior corner of said 20 acre <br />tract, same being the northwest line of said Block 11; <br />
