74. <br />Regular Meeting <br /> <br />November 24, 2003 <br /> <br />Page 4 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AMENDMENT TO EASEMENT AGREEMENT WITH JOYCE REASONER AND <br />HARRY REASONER FOR THE NORTH IH-35 WASTEWATER IMPROVEMENTS PROJECT; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Ms. Narvaiz moved for adoption of the Resolution with amendments and Mr. <br />Diaz seconded the motion. Mr. Mihalkanin inquired as to the amendments to <br />the contract. Mr. Mark Taylor stated the substantive change is the <br />deadline for the use of the roadway easement. He stated the City proposed <br />a nine year deadline, and the Reasoners countered with a three year <br />deadline, and both parties settled for five years. Mr. Taylor inquired <br />whether the City would have to pay for the expenses listed on 2, 3, 5, and <br />6 on the Agenda Request Form. Mr. O'Leary stated the City needed to cross <br />the Reasoners' property; and this was the cheapest alternative. Mr. Mark <br />Taylor stated the total cost would be $50,000.00, with the City bearing <br />part of the expenses. He also stated the Impact Fees are not part of this <br />agreement. He stated if this Resolution is approved, Staff will then move <br />forward with the wastewater agreement, and impact fees would be included in <br />those expenses. The Council then voted unanimously for adoption of the <br />Resolution. <br /> <br />Mayor Habingreither introduced for consideration Item 16, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING PRICE SELECT OPTIONS FOR THE PURCHASE OF WHOLESALE POWER <br />FROM THE LOWER COLORADO RIVER AUTHORITY; AUTHORIZING THE CITY MANAGER <br />TO EXECUTE A PRICE SELECT 2004 SELECTION FORM ON BEHALF OF THE CITY; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Narvaiz moved for adoption of the Resolution and Mr. Diaz seconded the <br />motion. Mr. Taylor inquired whether the City would continue to make <br />revenue off of key accounts. Bob Higgs, Director of San Marcos Electric <br />Utility, stated this agreement will help the City retain customers. He <br />also stated the City will not lose any revenues. The Council then voted <br />unanimously for adoption of the Resolution. <br /> <br />Mayor Habingreither introduced a discussion regarding the vehicle <br />inspection and maintenance program as part of Clean Air Force's Early <br />Action Compact Agreement. Mr. O'Leary stated Bill Gill with the Clean Air <br />Force and Hazel Barber with TCEQ are present to provide Council with some <br />measures proposed under the Early Action Compact. He also stated annual <br />vehicle inspections could increase costs. Some repairs to vehicles would <br />be required to be made. He also stated if the Council chooses to move <br />forward, this would probably go into effect in 2005. Mr. Thomaides <br />inquired as to the amount pollution would be reduced if enforced vehicle <br />inspections were implemented. Mr. Gill stated N0X would be reduced 3.19 <br />tons and VOC would be reduced 4.19 tons a day, .which is less than 10%. <br /> <br /> <br />
