<br />RESOLUTION 1987-72R <br /> <br />A RESOLUTION OF THE CITY OF SAN MARCOS, TEXAS <br />APPROVING THE TERMS AND CONDITIONS OF A <br />PROPOSED AGREEMENT WITH THE CITY OF KYLE, <br />TEXAS, ESTABLISHING RESPECTIVE <br />EXTRATERRITORIAL JURISDICTION BOUNDARIES, <br />RESCINDING A PRIOR SIMILAR AGREEMENT, <br />AUTHORIZING THE MAYOR TO EXECUTE SAID <br />AGREEf\1ENT ON BEHALF OF SAID CITY, AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />83 <br /> <br />WHEREAS, pursuant to the laws of the State of Texas, <br />cities of the State of Texas are authorized to enter into <br />contracts regarding both governmental and proprietary <br />functions; and, <br /> <br />WHEREAS, the extraterritorial jurisdictions of the City <br />of San Marcos and the City of Kyle now overlap due to the <br />expansion of their boundaries done under the authority of the <br />Municipal Annexation Act, Article 970a, Vernon's Texas Civil <br />Statutes; and, <br /> <br />WHEREAS, under the authority of Article 970a, Section 3, <br />Vernon's Texas Civil Statutes, said cities desire to realign <br />their respective extraterritorial jurisdiction boundaries to <br />eliminate any overlap, resolve boundary conflicts and <br />establish the effective jurisdictions of both cities now and <br />in the future for all purposes, including the regulating of <br />subdivision plats pursuant to Article 974a, Vernon I s Texas <br />Civil Statutes; and, <br /> <br />WHEREAS, on April 13, 1987, the San Marcos City Council <br />approved an agreement that would establish ETJ boundaries <br />with the City of Kyle and now desire to amend that agreement <br />which has not been approved by the City of Kyle; now, <br />therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. That that certain agreement between the City <br />of San Marcos and the City of Kyle establishing respective <br />ETJ boundaries between the two cities and which was approved <br />by the San Marcos City Council on April l3, 1987, is hereby <br />rescinded in its entirety. <br /> <br />PART 2. That the terms and conditions of a new <br />proposed agreement between said City and the City of Kyle, <br />Texas establishing their respective extraterritorial <br />jurisdiction boundaries, a copy of which is attached hereto <br />and incorporated herein for all purposes, are hereby in all <br />things approved. <br /> <br />PART 3. That the Mayor of said City is hereby <br />authorized to execute said agreement on behalf of the City of <br />San Marcos, Texas. <br /> <br />PART 4. That this Resolution shall be in full force <br />and effect from and after its passage. <br /> <br />ADOPTED this <br /> <br />8 <br /> <br /> <br />June <br /> <br />, 1987. <br /> <br />.
