<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE
<br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF
<br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL.
<br />66) BY ZONING 1.000 ACRES OF LAND OUT OF A 16.08 ACRE
<br />TRACT AS DESCRIBED IN VOLUME 320, PAGES 499-505 OF THE
<br />DEED RECORDS OF HAYS COUNTY, TEXAS, LOCATED AT THE CORNER
<br />OF RANCH ROAD 12 AND COUNTY ROAD 226 (ENTRANCE OF COUNTRY
<br />ESTATES AND SITE OF PAC-N-SAC) FROM "pD" (PRE-DEVELOPMENT
<br />DISTRICT) TO "C" (COMMERCIAL DISTRICT) AND DECLARING AN
<br />EFFECTI VE DATE.
<br />
<br />WHEREAS, on May 5,1987, the Zoning Commission of the City of
<br />San Marcos held a public hearing regarding a request to
<br />change the zoning from "PD" (Pre-Development District)
<br />to "c" (Commercial District) of 1.000 acres of land located at the
<br />corner of Ranch Road 12 and County Road 226 to the City of San Marcos,
<br />Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on May 5, 1987, con~ider said request and voted
<br />to approve the same and has recommended that such request be
<br />approved by the City Council of said City; and,
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />June, 1987, regarding such request; and,

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />MARCOS,
<br />
<br />.TEXAS:
<br />
<br />SECTION 1. That the following tract of real property located in
<br />San Marcos, Hays County, Texas, which was classified "PD"
<br />(Pre-Development District) upon its annexation to the City of San
<br />Marcos on July 28, 1986, henceforth shall be zoned as "C"
<br />(Commercial District):
<br />
<br />Being 1.000 acres of land out of a 16.08 acre tract as described
<br />in Volume 320, Pages 499-505 of the Deed Records of Hays County,
<br />Texas, and being more particularly described as follows:
<br />
<br />BEGINNING: At the Southwest corner of this tract, said point
<br />being S 87 degrees 27' OO"E 783.11 feet from the Southwest
<br />corner of the above mentioned tract;
<br />
<br />THENCE: N 02 degrees 33'

<br />THENCE: With the West line of a 50 foot wide road, S 33 degrees
<br />09' 00" W 25.00 feet and S 22 degrees 17'48" W 226.39 feet to
<br />the Southeast corner of this tract;
<br />
<br />THENCE: With the North line of R.M. Highway No. 12, along the
<br />arc of a curve to the left, said curve having a radius of
<br />2342.00 feet, a delta angle of 02 degrees 07'57", an arc length
<br />of 87.11 feet to the P.T. of this curve;
<br />
<br />THENCE: With said line, N 87 degrees 27'w 46.15 feet to the
<br />Point of Beginning and containing 1.000 acres of land, more or
<br />less.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on July 13, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
