<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING PART OF LOT 6, BLOCK 3, OF LINDSAY AND HARVEY
<br />ADDITION, AN ADDITION IN HAYS COUNTY, TEXAS, ACCORDING
<br />TO THE MAP OR PLAT THEREOF RECORDED IN VOLUME E, PAGE 416,
<br />OF THE DEED RECORDS OF HAYS COUNTY, TEXAS, LOCATED 516 W.
<br />HOPKINS STREET FROM "PH (PUB~C USE DISTRICT) TO HOP"
<br />(OFFICE PROFESSIONAL DISTRICT); AND DECLARING AN EFFECTIVE
<br />DATE.
<br />
<br />WHEREAS, on April 21, 1987 the Joint Planning and Zoning
<br />Commissions of the City of San Marcos held a public hearing regarding a
<br />request to change the zoning from "pH (Public Use District) to HOP"
<br />(Office Professional District) of part of Lot 6, Block 3, of the
<br />Lindsay and Harvey Addition to the City of San Marcos, Hays
<br />County, Texas; and,
<br />
<br />WHEREAS, subsequent
<br />Zoning Commission did,
<br />and voted to approve
<br />request be approved
<br />and,
<br />
<br />to said public hearing on said date, the
<br />on April 21,1987, consider said request
<br />the same and has recommended that such
<br />by the City Council of said City;
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />July, 1987, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />"PH (Public Use District) be rezoned HOP" (Office Professional
<br />District) :
<br />
<br />Part of Lot 6, Block 3, of Lindsay and Harvey Addition, an
<br />addition in Hays County, Texas according to the Map or Plat
<br />thereof recorded in Volume E, Page 416, of the Deed Records of
<br />Hays County, Texas, being more particularly described by metes
<br />and bounds as follows:
<br />
<br />BEGINNING at the East corner of said Lot No. Six (6) in the
<br />Northwest line of Hopkins Street, same being South corner of Lot
<br />No. Seven (7) in said Block No. Three (3);
<br />
<br />THENCE N. 44 degrees 8' W. 84.27 feet to the Southeast edge of a
<br />stone wall running across said Lot No. Six (6), same being the
<br />East corner of the Buford Williams lot;
<br />
<br />THENCE S. 45 degrees 48' W. along the Southeast edge of said
<br />stone wall, 83.3 feet to an iron stake set in the line between
<br />Lots Nos. Five (5) and Six (6) in said Block No. Three (3),
<br />
<br />THENCE S. 44 degrees 48' E. 85.37 feet to the South corner of
<br />said Lot No. Six (6) in said Northwest line of Hopkins Street;
<br />
<br />THENCE with said street line N. 45 degrees E. 83.33 feet, To The
<br />Place of Beginning, being the same property described in deed
<br />dated May 1,1941, from the Presbyterian Church of the United
<br />States to the First American Lutheran Church of San Marcos,
<br />recorded }TI Volume 122, Page 135, Hays County Deed Records.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on July 27, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
