<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, N1ENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING 1.003 ACRES OF LAND OUT OF A 16.08 ACRE TRACT AS
<br />DESCRIBED IN VOLUME 320, PAGES 499-505 OF THE DEED RECORDS
<br />OF HAYS COUNTY, TEXAS, LOCATED ON THE NORTHSIDE OF RANCH
<br />ROAD 12 FROM "PD" (PREDEVELOPMENT DISTRICT) TO "C"
<br />(COMMERCIAL DISTRICT); AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on May 19, 1987 the Joint Planning and Zoning Commission
<br />of the City of San Marcos held a public hearing regarding a request to
<br />change the zoning from "PD" (Predevelopment District) to "c"
<br />(Commercial District) of 1.003 acres of land out of a 16.08 acre tract
<br />to the City of San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent
<br />Zoning Commission did,
<br />and voted to approve the
<br />request be approved
<br />City; and,
<br />
<br />to said public hearing on said date, said
<br />on May 19,1987, consider said request
<br />same and has recommended that such
<br />by the City Council of said
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />July, 1987, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN

<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which was
<br />classified "PD" (Predevelopment District) upon its annexation to the
<br />City of San Marcos on July 28,1986, henceforth shall be zoned as
<br />"c" (Commercial District):
<br />
<br />BEING 1.003 acres of land out of a 16.08 acre tract of land as
<br />described in deed recorded in Volume 320, Pages 499-505 of the
<br />Deed Records of Hays County, Texas, and being more particularly
<br />described as follows:
<br />
<br />BEGINNING at the Southwest corner of this tract, said point
<br />being S. 87 degrees 27' 00" East 330.95 feet from the Southwest
<br />corner of the above mentioned tract;
<br />
<br />THENCE, N. 02 degrees 33'
<br />corner of this tract;

<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on July 27, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />subject to reconsideration at the next
<br />scheduled for July 27, 1987
