(10 "" 149 ORDINANCE 1987- 99 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING APPENDIX A, THE GENERAL ZONING ORDINANCE OF THE SAN MARCOS CODE OF ORDIN.AJ.\TCES BY PROVIDING FOR ZONING CHANGES ON ONE READING, PROVIDING A THREE-FOURTHS CITY COUNCIL VOTE TO OVERRULE A ZONING COMMISSION DENIAL, PROVIDING FOR AN OFFICIAL ZONING MAP, DELETING UNNECESSARY DEFINITIONS, ADOPTING NEW DEFINITIONS, PROVIDING NEW AREA REQUIREMENTS FOR ZONING DISTRICTS, PROVIDING PERMITTED AND SPECIFIC USES FOR ZONIN~ DISTRICTS, DELETING PROHIBITED USES FOR ZONING DISTRICTS, PROVIDING PARKING SPACE REGULATIONS, AND DECLARING AN EFFECTIVE DATE. IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, PART 1. That Section 2(B) of the San Marcos General Zoning Ordinance is amended by the addition of the following sentence: Ordinances relating to the changing of a zoning district designation may be approved by the City Council on one reading only, if all other requirements are met, but may be reconsidered upon a majority vote at the next regular meeting after the change was approved if such reconsideration is requested by a Council Member who was absent from the meeting where the vote was taken or who voted on the prevailing side at the previous meeting. PART 2. That Section 2(D) (2) of the San Marcos General Zoning Ordinance is repealed and the following is adopted in its place: Section 2. Amendments, procedures, fi1ing fee, and appea1s from decision of the zoning commission. (D) Protests and recommendations for denial: (2 ) A vote of three-fourths of all the members of the San Marcos City Council is also required to overrule a recommendation of the Zoning Commission that the proposed amendment, supplement or change be denied. PART 3. That Section 3 of the San Marcos General Zoning Ordinance is repealed and the following is adopted in its place: Section 3. Officia1 zoning map. (A) The official zoning map of the City of San Marcos shall be kept in the official files of the City Secretary. Certified copies shall be maintained in the office of the Planning Department. The map entitled IIZoning Map of the City of San Marcos, Texas," shall constitute an official part of this ordinance. The boundaries of the districts referred to in this ordinance are indicated on the zoning map of the City which is adopted with and declared to be a part of this chapter (appendix). All notations, references and other information shown on the zoning map are made a part of this ordinance, and shall be considered as much a part of it as if the matters of information it sets forth were all fully contained and described here.
