80. <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />COUNTY OF HAYS <br />INTERLOCAL AGREEMENT <br /> <br />SECTION I. PARTIES TO CONTRACT <br /> <br /> Tiffs contract is made and entered into by and between the County of Hays, hereinafter referred to as <br />"County", represented by County Judge Jim Powers, and the City of San Marcos hereinafter referred to as <br />"Contractor", represented by Dan O'Leary, City Manager. The parties enter into this Agreement under the <br />authority of the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code, as amended. The parties <br />hereto have severally and collectively agreed and by execution hereof are bound to the mutual obligations and to the <br />performance and accomplishment of the tasks hereinafter described. Failure to comply with any item(s) of this <br />contract can delay future quarterly payments until the item(s) of non-compliance is resolved. <br /> <br />SECTION II. CONTRACTOR PERFORMANCE <br /> <br />Provide free library services to residents of Hays County. <br /> <br />SECTION IH. CONTRACT PERIOD <br /> <br /> The period for performance of tkis contract shall commence October 1, 2003 and shall terminate September <br />30, 2004. <br /> <br />SECTION IV. COUNTY OBLIGATION <br /> <br /> Notwithstanding any other provision of this contract, the total payment of all payments and other <br />obligations made or incurred by the County hereunder shall not exceed the sum of $55,360. Both parties <br />acknowledge that the County's payment for library services will be made from current revenues available to it, and <br />that the payment under this agreement is in an amount that fairly compensates Contractor for the provision of these <br />library services. <br /> <br />SECTION V. REPORTS <br /> <br /> The Contractor shall submit to the Hays County Auditor on the following days during the contract period <br />on the county-provided report form the financial status rendered by Contractor under this contract. <br /> <br />February 1, for the quarter ending December 31 <br />May 1, for the quarter ending March 31 <br />August 1, for the quarter ending June 30 <br />November 1, for the quarter ending September 30 <br /> <br /> The County, at its option, reserves the right to have Contractor submit other information and records <br />pertinent to Contractors performances hereunder as may be reasonably required by County. <br /> <br />SECTION VI. COUNTY MONITORING <br /> <br /> The Contractor shall permit County to inspect and shall make available to the County for inspection any or <br />all pertinent records, files, information or other written material maintained by Contractor or any person or other <br />entity with whom any portion of the performance hereunder has been subcontracted. The Contractor shall permit <br />County free access to all premises under its control or under the control of any person or entity with whom any <br />portion of the peffonmnce hereunder has been subcontracted. <br /> <br />SECTION VH. SUBCONTRACTS <br /> <br />The Contractor shall subcontract for the performances specified herein only where such subcontracts and <br /> 1 <br /> <br /> <br />
