ARTICLE XII AWARDING SALE OF THE CERTIFICATES OF OBLIGATION AND APPROVAL OF OFFICIAL STATEMENT Section 12.01. Awarding Sale of the Certificates. The Certificates are hereby officially sold and awarded to Rob", ~\'C:I h~(;. at a price of par, plus accrued interest from the date of the Certificates to the Closing Date, and a premium of - 0- Section 12.02. Approval of Official Statement. The form and substance of the Official Statement for the Certificates and any addenda, supplement or amendment thereto (the "Official Statement"), are hereby in all respects approved and adopted by the City Council. Said Official Statement as thus approved, executed and delivered, with such appropriate variations as thus approved may be used by said purchasers in the public offering and sale of the Certificates. ARTICLE XIII PUBLIC MEETING Section 13.01. Public Meeting. It is officially found, determined, and declared that the meeting at which this Ordinance has been adopted was open to the public and public notice of the time, place and subject matter of the public business to be considered and acted upon at said meeting, including this Ordinance, was given, all as required by the applicable provisions of Article 6252-17, V.T.C.S., as amended. Section 13.02. Emergency Declaration. The public importance of this measure and the fact that it is to the best interest of the City to provide funds for the proposed improvements at the earliest possible date, for the immediate preservation of the public peace, health and safety, constitutes and creates an emergency and an urgent public necessity requiring that the Charter rule requiring ordinances to be read on three several days be dispensed with for the purpose of adopting this Ordinance as an emergency measure; and said Charter rule is hereby dispensed with and this Ordinance is accordingly passed as an emergency measure, effective and in force immediately upon and after its passage. 0405s -25-
