<br />00 <br /> <br /> <br />211 <br /> <br /> <br />ORDINANCE 1987- 116 <br /> <br />~ <br />-.) <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 31, MUNICIPAL AIRPORT, OF <br />THE SAN MARCOS CODE OF ORDINANCES BY CLARIFYING OWNER <br />AND PILOT RESPONSIBILITIES FOR TIE-DOWN FEES AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />TEXAS: <br /> <br />PART 1. That Section 31-11.2 of the San Marcos Code of Ordinances <br />is repealed and the following adopted in its place: <br /> <br />Sec. 31-11. <br /> <br />Operations. <br /> <br />2. <br /> <br />Tie-down of Aircraft <br /> <br />Aircraft not hangared shall be tied down and secured at <br />night. The aircraft owner and the owner's agent and the <br />pilot are legally responsible for tie-down and security of <br />the aircraft, for inspection of tie-down equipment, and <br />for payment of the $30 per month tie-down fee for <br />aircraft leased at the airport, or for the $2.50 per night <br />tie-down fee for transient aircraft. Proof that the <br />aircraft has been tied down at the airport creates a legal <br />presumption that the owner, agent, and pilot are <br />responsible for paying the tie-down fee. <br /> <br />SECTION 2.
