<br />AN ORDIN~~1CE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING OF ALL OF BLOCKS 3 AND 4, VICTORY GARDENS-FIRST
<br />SECTION, SAN MARCOS, TEXAS, AS RECORDED IN VOLUME 128,
<br />PAGE 46 OF HAYS COUNTY DEED RECORDS, LOCATED ON THE 200
<br />BLOCK OF CAMACHO STREET; 200 BLOCK (EVEN) OF ROOSEVELT
<br />STREET; AND 600 BLOCK (EVEN) OF MACARTHUR STREET,
<br />FROM "M" (SINGLE, DUPLEX AND NEIGHBORHOOD BUSINESS
<br />DISTRICT) TO "R-2" (SINGLE FAMILY DWELLING DISTRICT-MEDIUM
<br />DENSITY); AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on July 16,1987 the Planning and Zoning Commissions
<br />of the City of San Marcos held a public hearing regarding a request
<br />to change the zoning from "M" (Single, Duplex and Neighborhood Business
<br />District) to "R-2" (Single Family Dwelling District) of all of Blocks
<br />3 and 4, Victory Gardens-First Section to the City of San Marcos, Hays
<br />County, Texas; and,
<br />
<br />WHEREAS, subsequent
<br />Zoning Commission did,
<br />and voted to approve the
<br />request be approved
<br />City; and,
<br />
<br />to said public hearing on said date, the
<br />on July 16,1987, consider said request
<br />same and has recommended that such

<br />WHEREAS, said City Council held a public hearing on the
<br />August, 1987, regarding such request; and,

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />zoned "M" (Single, Duplex and Neighborhood District) be rezoned
<br />"R-2" (Single Family Dwelling District-Medium Density):
<br />
<br />ALL OF BLOCKS 3 AND 4, VICTORY GARDENS-FIRST SECTION, SAN
<br />MARCOS, TEXAS AS RECORDED IN VOLUME 128, PAGE 46 OF HAYS COUNTY
<br />DEED RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (lO) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on September 14, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this
<br />subject to reconsideration at the next
<br />scheduled for September 14, 1987 .
