11-17-03 e Easement shall take effect as of the date of the City's notice to the Reasoners of the impending construction of such pipeline, and shall expire and all rights therein automatically revert to the Reasoners free and clear of any right, title or interest in the City six months after the date of the City's notice to the Reasoners for such pipeline, but in no event later than one year from the date of this Amendment. Paragraph (4) of the Agreement is amended to read as follows: (4) The 1.15 Acre Permanent Easement shall be used solely to construct, maintain, and operate one 24 inch inside diameter wastewater pipeline (including connecting pipelines to serve all parts of the Reasoner Tract). Paragraph (8) of the Agreement is amended to read as follows: (8) The construction of the 24 inch inside diameter wastewater pipeline within the 1.15 Acre Permanent Easement shall be completed within one year after the effective date of this Amendment (the "Initial Construction Period"). Paragraph (10) of the Agreement is amended to read as follows: (10) The 1.77 Acre Permanent Easement shall be used solely by the City to construct, maintain, repair, and operate a first-class, paved roadway and necessary drainage for the roadway, and to construct and maintain four curbcuts, a minimum width of 25 feet, to access the Reasoner Tract. The City shall have no right to use or to allow the use of the area included within the 1.77 Acre Permanent Easement for any other purpose than a paved roadway including, but not limited to, use for the construction and operation of any type of pipeline, powerline, telephone or telecommunications line; provided, however, that if construction of the roadway is not substantially completed on or before nine years from the date of this Amendment, the City shall have no further right, title, or interest in the 1.77 acre Permanent Easement, but shall have the duty and -3-
