11-17-03 <br /> <br />e <br /> <br />Easement shall take effect as of the date of the City's notice to the Reasoners of the <br />impending construction of such pipeline, and shall expire and all rights therein <br />automatically revert to the Reasoners free and clear of any right, title or interest in the <br />City six months after the date of the City's notice to the Reasoners for such pipeline, but <br />in no event later than one year from the date of this Amendment. <br />Paragraph (4) of the Agreement is amended to read as follows: <br /> <br /> (4) The 1.15 Acre Permanent Easement shall be used solely to construct, <br />maintain, and operate one 24 inch inside diameter wastewater pipeline (including <br />connecting pipelines to serve all parts of the Reasoner Tract). <br />Paragraph (8) of the Agreement is amended to read as follows: <br /> <br /> (8) The construction of the 24 inch inside diameter wastewater pipeline within <br />the 1.15 Acre Permanent Easement shall be completed within one year after the effective <br />date of this Amendment (the "Initial Construction Period"). <br />Paragraph (10) of the Agreement is amended to read as follows: <br /> <br /> (10) The 1.77 Acre Permanent Easement shall be used solely by the City to <br />construct, maintain, repair, and operate a first-class, paved roadway and necessary <br />drainage for the roadway, and to construct and maintain four curbcuts, a minimum width <br />of 25 feet, to access the Reasoner Tract. The City shall have no right to use or to allow <br />the use of the area included within the 1.77 Acre Permanent Easement for any other <br />purpose than a paved roadway including, but not limited to, use for the construction and <br />operation of any type of pipeline, powerline, telephone or telecommunications line; <br />provided, however, that if construction of the roadway is not substantially completed on <br />or before nine years from the date of this Amendment, the City shall have no further <br />right, title, or interest in the 1.77 acre Permanent Easement, but shall have the duty and <br /> <br />-3- <br /> <br /> <br />
