<br />236 <br /> <br />THE STATE OF TEXAS <br /> <br />RELEASE <br /> <br />COUNTY OF HAYS <br /> <br />WHEREAS, the City of San Marcos, Texas, is considering the <br /> <br />matter <br /> <br />of <br /> <br />vaca ting <br /> <br />and <br /> <br />abandoning an eighteen (18) foot alley and a portion <br /> <br />of <br /> <br />an <br /> <br />eighteen (18') foot alley in the Harle and Hofheinz Subdivision <br /> <br />of Block <br /> <br />No.1, J.F. McGehee Addition, To <br /> <br />The <br /> <br />Ci ty Of <br /> <br />San <br /> <br />Marcos, <br /> <br />Texas, <br /> <br />and <br /> <br />being <br /> <br />those parcels of land which abut Lots 1,2,3,4,5 <br /> <br />and 12 of said addition, an alley dedicated to the public as <br /> <br />shown <br /> <br />on <br /> <br />the plat of said <br /> <br />addition <br /> <br />of <br /> <br />record <br /> <br />in <br /> <br />Volume 56, Page 139, Hays <br /> <br />County Deed Records; and, <br /> <br />WHEREAS, Leon R. <br /> <br />Ki ng is <br /> <br />the <br /> <br />owner of <br /> <br />property <br /> <br />abutting <br /> <br />said <br /> <br />portion of said alley, to-wit: Lots 1, 2, 3, 4, 5 and 12; and, <br /> <br />\:VHEREAS, <br /> <br />it <br /> <br />lS <br /> <br />to <br /> <br />the <br /> <br />advantage <br /> <br />of <br /> <br />the <br /> <br />said Leon R. <br /> <br />King <br /> <br />whose <br /> <br />property <br /> <br />abuts said parcels of land in <br /> <br />the said addition <br /> <br />and to the advantage of the public generally to abandon said portion of <br /> <br />said alley; <br /> <br />NOW, <br /> <br />THEREFORE, <br /> <br />in <br /> <br />consideration <br /> <br />of benefits to be received by <br /> <br />Leon <br /> <br />R. <br /> <br />King <br /> <br />and <br /> <br />the <br /> <br />general <br /> <br />public, <br /> <br />which <br /> <br />ar-e <br /> <br />hereby <br /> <br />ack nowledg ed, <br /> <br />the <br /> <br />said Leon R. King does <br /> <br />hereby <br /> <br />fully <br /> <br />and <br /> <br />foreve r <br /> <br />release, acquit and discharge said City, its officers, successor-s <br /> <br />and <br /> <br />assigns, <br /> <br />fr-om <br /> <br />any <br /> <br />and <br /> <br />all <br /> <br />actions, <br /> <br />causes <br /> <br />of action, claims and <br /> <br />demands of whatsoever kind or nature <br /> <br />on account of <br /> <br />the <br /> <br />vacation <br /> <br />and <br /> <br />abandonment <br /> <br />of <br /> <br />said <br /> <br />parcels <br /> <br />of <br /> <br />land <br /> <br />in <br /> <br />the Harle and Hofheinz <br /> <br />Subdivision of Block <br /> <br />No.1, <br /> <br />J. F. <br /> <br />McGehee <br /> <br />Addition, of <br /> <br />San <br /> <br />Marcos, <br /> <br />Texas, <br /> <br />said <br /> <br />parcels <br /> <br />of <br /> <br />land having been more particularly described <br /> <br />hereinabove. <br /> <br />It is <br /> <br />expressly <br /> <br />understood <br /> <br />and <br /> <br />agreed <br /> <br />that <br /> <br />this <br /> <br />release <br /> <br />is intended <br /> <br />as <br /> <br />an <br /> <br />ag reemen t <br /> <br />to <br /> <br />the <br /> <br />vacation and <br /> <br />abandonment <br /> <br />of <br /> <br />said parcels of land and is intended to cover <br /> <br />all <br /> <br />damages, losses and <br /> <br />injuries <br /> <br />now <br /> <br />known <br /> <br />or which <br /> <br />may <br /> <br />become <br /> <br />known <br /> <br />in <br /> <br />the <br /> <br />fu ture , <br /> <br />inc luding <br /> <br />all <br /> <br />the <br /> <br />effects <br /> <br />and <br /> <br />consequences <br /> <br />thereo f. <br />
