PROFESSIONAL ENGINEERING SERVICES AGREEMENT <br />This Agreement is made this the 17th day of June, 2008, between the City of San Marcos, <br />Texas ("City"), 630 East Hopkins, San Marcos, Texas 78666 and Kellogg Brown & Root <br />Services, Inc., a Delaware Corporation ("Engineer"), 505 E. Huntland Drive, Suite 100, Austin, <br />Texas 78752 for the provision of professional engineering services in connection with the <br />Sessom Drive Roadway Improvements Project (the "Project"). <br />The City and the Engineer agree as follows: <br />ARTICLE 1 <br />ENGINEER'S SERVICES AND RESPONSIBILITIES <br />1.0 STANDARDS OF PERFORMANCE <br />1.0.1 Engineer will be responsible for the proper, accurate and adequate design and <br />preparation of plans and specifications and other construction contract documents and for <br />construction administration for the Project. The Project consists of improvements to Sessom <br />Drive from Aquarena Springs Drive to Academy Street. Sessom Drive currently is a heavily <br />traveled major arterial serving as a major east/west thoroughfare that borders the Texas State <br />University -San Marcos ("TxState") campus. It is currently a 4-lane roadway with no shoulders <br />and limited sidewalks on the east end. The proposed improvements consist of minor street <br />reconstruction, repair of drainage inlet boxes, intersection improvements, installation of culverts <br />and guard rails around curves and steep drop offs, and bicycle and pedestrian improvements <br />throughout various segments of the roadway. <br />1.0.2 The Engineer understands that funding for this Project is being provided by two sources: <br />a) For minor street reconstruction and improvements, the Project is considered a Surface <br />Transportation Program -Metro Mobility ("STP-MM") Project, partly funded by the <br />Federal Highway Administration ("FHWA") through a grant administered by the <br />Texas Department of Transportation ("TxDOT") under the terms of a Local <br />Transportation Project Advanced Funding Agreement and all design work and <br />construction documents will meet American Association of State Highway Officials <br />("AASHTO") standards at a minimum, but will attempt to meet TxDOT standards as <br />indicated in this Agreement. <br />b) The drainage improvements will be financed by Revenue Bonds issued by the City <br />and all design work related to these improvements will meet City of San Marcos and <br />City of Austin standards and specifications. <br />1.0.3 The Engineer's Basic Services consist of the services described in Sections 1.0 through 1.5 <br />and include normal civil engineering services as well as those engineering services to be <br />performed through the following consulting disciplines as subcontractors to the Engineer: <br />a) Blanton & Associates, Inc. -Environmental Services <br />KBR-Sessom Drive Roadway Improvements Agreement <br />1 <br />
