88. RESOLUTION NO. 2003- 208 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING PRICE SELECT OPTIONS FOR THE PURCHASE OF WHOLESALE POWER FROM THE LOWER COLORADO RIVER AUTHORITY; AUTHORIZING THE CITY MANAGER TO EXECUTE A PRICE SELECT 2004 SELECTION FORM ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City purchases electric power from the Lower Colorado River Authority CLCRA") under a Wholesale Power Agreement dated July 8, 1986, as amended by the Amendment to Wholesale Power Agreement dated June 24, 1996. 2. LCRA uses a Price Select option program to allow its wholesale customers to choose among pricing options for the purchase of wholesale electric power, and the City Wishes to select Price Select wholesale electric power pricing options for calendar year 2004. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The pricing options for the purchase of electric power from the LCRA as shown on the City's Price Select 2004 Selection Form are approved. PART 2. The City Manager, Dan O'Leary, is authorized to execute the City's Price Select 2004 Selection Form on behalf of the City. PART 3. In accordance with Resolution No. 2001-195R, the City's Price Select 2004 Selection Form relates to "power supply pricing, proposals and contracts," and therefore constitutes "competitive information" under Section 552.131 of the Texas Government Code. The City's Price Select 2004 Selection Form is not public information and is not subject to diiclosure to the public. PART 4.
