<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING OF 84.17 ACRES, MORE OR LESS OUT OF THE J.M.
<br />VERAMENDI LEAGUE NO.1, FROM BEING "PD" (PRE-DEVELOPMENT
<br />DISTRICT), "P" (PUBLIC USE), "R-l" (SINGLE FAflHLY DWELLING
<br />DISTRICT-LOW DENSITY), AND "C" (COMMERCIAL DISTRICT) TO
<br />"PDD" (PLANNED DEVELOPMENT DISTRICT); APPROVING A PDD
<br />DEVELOPMENT PLAN FOR SAID 84.17 ACRE TRACT AND DECLARING
<br />AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on June 16, 1987 the Joint Planning and Zoning
<br />Commission of the City of San Marcos held a public hearing regarding
<br />a request to change the zoning from "PDII (Predevelopment District)
<br />to "P" (Public District), "R-l" (Single-Family Dwelling District-Low
<br />Density) and "C" (Commercial District) to "PDD" (Planned Development
<br />District) of 84.17 acres of land out of the J.M. Veramendi
<br />League No.1, said land being located in San Marcos, Hays County,
<br />Texas; and,
<br />
<br />WHEREAS, subsequent to said
<br />Commissions did, on June 16,1987,
<br />and the Zoning Commission voted to
<br />recommended that such request be
<br />Council of said City; and,
<br />
<br />public hearing on said date, said
<br />consider said request
<br />approve the same and has
<br />approved by the City
<br />
<br />WHEREAS, said City Council held a public hearing on the
<br />of September, 1987, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, Section 400, Chapter 35, Comprehensive Development Code,
<br />of the Code of Ordinances of the City of San Marcos empowers the
<br />Planning and Zoning Commissions of the City of San Marcos to recommend
<br />approval of a PDD Development Plan.

<br />VVHEREAS, on June 16, 1987, the Zoning Commisson of said City
<br />recommended approval of a PDD Development Plan for said 84.17 acre
<br />tract of land, out of the J.M. Veramendi League No.1; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />MARCOS,

<br />TEXAS:
<br />
<br />SECTION 1. That the following described tracts of real property
<br />located in San Marcos, Hays County, Texas, which were
<br />classi fied "PD" (Predevelopment District), "P" (Public Use), "R-l"
<br />(Single-Family Dwelling District-Low Density) and "c" (Commercial
<br />District) upon their annexation to the City of San Marcos on November
<br />24,1980, henceforth shall be zoned as "PDD" (Planned Development
<br />District):

<br />1, Abstract No. 17, Hays County, Texas, same being a portion of
<br />an 82.06 acre tract of land recorded in Volume 470, Page 403,
<br />Deed Records of Hays County, Texas, and described more
<br />particularly as follows:
<br />
<br />BEGINNING at the North corner of the aforementioned 82.06 acres;
<br />
<br />THENCE along a northeast line of the aforementioned 82.06 acres,
<br />S44 degrees 57'14"E a distance of 314.72 feet, S43 degrees
