~ 9- ~ 43 ORDINANCE 1987- 129 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 9 1/2-1(a) AND (b) OF CHAPTER 9 1/2 OF THE CODE OF ORDINANCES OF SAID CITY TO PROVIDE FOR THE FlUNG IN THE OFFICE OF THE CITY SECRETARY SAN MARCOS ELECTRIC UTILITY (SMEU) RULES AND REGULATIONS AND ANY AMENDMENTS THERETO AND SMEU LINE EXTENSION POLICY AND ANY AMENDMENTS THERETO, TO ADD A SUBSECTION (c) THERETO AMENDING THE INTERIM SMEU ELECTRIC TARIFFS BY ADOPTING SMEU ELECTRIC TARIFFS; AMENDING SECTION 9 1/2-2 OF SAID CHAPTER OF SAID CODE TO ADD A SUBSECTION (g) TO PROVIDE THAT ANY AMENDMENTS TO THE SMEU RU LES AND REGU LATIONS ADOPTED BY THE SMEU BOARD SHALL BE PROVIDED TO THE CITY SECRETARY AND SHALL REMAIN ON FILE IN THE OFFICE OF THE CITY SECRETARY WITH THE ORIGINALLY ADOPTED RULES AND REGULATIONS; AMENDING SECTION 9 1/2-3 OF SAID CHAPTER OF SAID CODE TO ADD A SUBSECTION (g) TO PROVIDE THAT ANY AMENDMENTS TO THE SMEU LINE EXTENSION POLICY ADOPTED BY THE SMEU BOARD SHALL BE PROVIDED TO THE CITY SECRETARY AND SHALL REMAIN ON FILE IN THE OFFICE OF THE CITY SECRETARY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 9 1/2-1 of Chapter 9 1/2 of the Code of Ordinances of said City is hereby amended to read as follows: Sec. 9 1/2-1. San Marcos Electric Utility Interim Rules And Regulations, Interim Line Extension Policy, And Electric Tariffs. (a) The San Marcos Electric Utility Interim Rules and Regulations are hereby adopted as The San Marcos Electric Utility Rules and Regulations, a copy of which are attached hereto as Exhibit A and incorporated herein for all purposes,and are subject to amendment as provided below in Sec. 9 1/2-2. (b) The San Marcos Electric Utility Interim Line Extension Policy is hereby adopted as the San Marcos Electric Utility Line Extension Policy, a copy of which is attached hereto as Exhibit B and incorporated herein for all purposes, and is subject to amendment as provided below in Section 9 1/2-3. (c) The City of San Marcos Interim Electric Tariffs adopted on September 22,1986, are hereby amended by the adoption of the San Marcos Electric Utility Tariffs set forth in Exhibit C, which is attached hereto and incorporated herein for all purposes, and said tariffs are hereby adopted and shall remain in full force and effect until amended by ordinance duly passed, approved and adopted by the City Council of the City of San Marcos, Texas. Said exhibit shall remain on file in the office of the city secretary of said City. SECTION 2. That Section 9 1/2-2 of Chapter 9 1/2 of the Code of Ordinances of said City is hereby amended to add subsection (g) which shall read as follows: Sec. 9 1/2-2. San Marcos Regulations. Electric Utility Rules and (g) Any and all amendments of the San Marcos Electric Utility Rules and Regulations adopted by the San Marcos Electric Utility Board shall be provided to the city secretary and shall remain on file in the office of the city secretary with the originally adopted rules and regulations. SECTION 3. That Section 9 1/2-3 of Chapter 9 1/2 of the Code of Ordinances of said City is hereby amended to add subsection (g) which shall read as follows:
