<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, N1ENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING LOTS 6 & 7, BLOCK 10, VICTORY GARDENS, FIRST
<br />ADDITION, SAN MARCOS, HAYS COUNTY, TEXAS, AS RECORDED IN
<br />VOLUME 128, PAGE 46 OF THE DEED RECORDS OF HAYS COUNTY,
<br />TEXAS, LOCATED AT 319 ROOSEVELT STREET FROM "M" (SINGLE
<br />FAl'lILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT) TO "MR"
<br />(MOBILE HOME AND RESIDENTIAL DISTRICT); AND DECLARING AN
<br />EFFECTIVE DATE.
<br />
<br />WHEREAS, on August 4,1987 the Zoning Commission of the City of
<br />San Marcos held a public hearing regarding a request to change
<br />the zoning from "M" (Single Family, Duplex and Neighborhood
<br />Business District) to "MR" (Mobile Home and Residential District) of
<br />Lots 6 & 7, Block 10, Victory Gardens First Addition, to the City of
<br />San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said
<br />Commission did, on August 4, 1987, consider said
<br />and voted to approve the same and has recommended
<br />request be approved by the City Council of
<br />Ci ty ; and,
<br />

<br />of September, 1987, regarding such request; and,

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
<br />
<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />"M" (Single Family, Duplex and Neighborhood Business District) be
<br />rezoned "MR" (Mobile Home and Residential District):
<br />
<br />LOTS 6 & 7, BLOCK 10, VICTORY GARDENS, FIRST ADDITION, SAN
<br />MARCOS, HAYS COUNTY, TEXAS, AS RECORDED IN VOLUME 128, PAGE 46
<br />OF THE DEED RECORDS OF HAYS COUNTY, TEXAS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on October 12, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this
<br />subject to reconsideration at the next
<br />scheduled for October 12, 1987
