47 ORDINANCE 1987- 132 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 12, SECTION 12-8(e) OF THE SAN MARCOS CODE OF ORDINANCES BY REDUCING THE MONTHLY DEPOSIT INTO AN ESCROW OR RESERVE FUND FOR THE PLANNING AND ACQUISITION OF A SANITARY LANDFILL SITE OR COMPARABLE FACILITY, AND DECLARING AN EMERGENCY. WHEREAS, the charges to residential customers for the collection of garbage and rubbish from residential units in the City is $6.00 per unit per month pursuant to Chapter 12, Section 12-8(a) of the San Marcos Code of Ordinances: and, WHEREAS, Chapter 12, Section 12-8(e) of the San Marcos Code of Ordinances provides for the deposit of $1.00 from each monthly charge, per unit, by the Director of Finance into an escrow or reserve fund to be used for the planning and acquisition of a sanitary landfill or comparable facility; and, WHEREAS, by resolution passed by the City Council of the City of San Marcos on September 14, 1987, the fee paid to Browning-Ferris, Inc. for the collection of garbage and rubbish from residential units located in the City was increased to $5.40 per unit per month; now, therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Chapter 12, Section 12-8(e) of the San Marcos Code of Ordinances be amended to read as follows: Sec. 12-8. Garbage and rubbish collection charges by city for residential units. (e) An escrow or reserve fund shall be established by the director of finance. The funds deposi ted in such account are to be used for the planning and acquisition of a sanitary landfill site or comparable facility (e.g., resource recovery) which will be used by the city for disposal of garbage and rubbish. From each monthly charge, per unit; the director of finance shall cause to be deposited sixty cents ($.60) in said escrow or reserve fund. SECTION 2. That the importance of this Ordinance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall be presented at three separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage be suspended, and these provisions are hereby suspended, and this Ordinance shall take effect and be in full force and effect from and after its publication in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
