<br /> <br /> <br /> <br />47 <br /> <br />ORDINANCE 1987- 132 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING <br />CHAPTER 12, SECTION 12-8(e) OF THE SAN <br />MARCOS CODE OF ORDINANCES BY REDUCING THE <br />MONTHLY DEPOSIT INTO AN ESCROW OR RESERVE <br />FUND FOR THE PLANNING AND ACQUISITION OF <br />A SANITARY LANDFILL SITE OR COMPARABLE <br />FACILITY, AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the charges to residential customers for the <br />collection of garbage and rubbish from residential units in <br />the City is $6.00 per unit per month pursuant to Chapter 12, <br />Section 12-8(a) of the San Marcos Code of Ordinances: and, <br /> <br />WHEREAS, Chapter 12, Section 12-8(e) of the San Marcos <br />Code of Ordinances provides for the deposit of $1.00 from <br />each monthly charge, per unit, by the Director of Finance <br />into an escrow or reserve fund to be used for the planning <br />and acquisition of a sanitary landfill or comparable <br />facility; and, <br /> <br />WHEREAS, by resolution passed by the City Council of the <br />City of San Marcos on September 14, 1987, the fee paid to <br />Browning-Ferris, Inc. for the collection of garbage and <br />rubbish from residential units located in the City was <br />increased to $5.40 per unit per month; now, therefore <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. That Chapter 12, Section 12-8(e) of the <br />San Marcos Code of Ordinances be amended to read as follows: <br /> <br />Sec. 12-8. Garbage and rubbish collection charges <br />by city for residential units. <br /> <br />(e) An escrow or reserve fund shall be <br />established by the director of finance. The funds <br />deposi ted in such account are to be used for the <br />planning and acquisition of a sanitary landfill <br />site or comparable facility (e.g., resource <br />recovery) which will be used by the city for <br />disposal of garbage and rubbish. From each monthly <br />charge, per unit; the director of finance shall <br />cause to be deposited sixty cents ($.60) in said <br />escrow or reserve fund. <br /> <br />SECTION 2. That the importance of this Ordinance <br />creates an emergency and an imperative public necessity so <br />that the provisions of the Charter requiring that ordinances <br />shall be presented at three separate meetings and that no <br />ordinance shall become effective until the expiration of ten <br />(10) days following the date of its final passage be <br />suspended, and these provisions are hereby suspended, and <br />this Ordinance shall take effect and be in full force and <br />effect from and after its publication in a newspaper of <br />general circulation in the area as required by the Charter of <br />the City of San Marcos, Texas. <br /> <br />PASSED, APPROVED <br />September, 1987. <br /> <br />AND <br /> <br />ADOPTED <br /> <br />this <br /> <br />28 <br /> <br />day <br /> <br />of <br /> <br />~ <br /> <br /> <br />Mayor <br />
