<br />contract <br /> <br />-2- <br /> <br />by <br /> <br />PHS. <br /> <br />Notwithstanding the foregoing requirements of this <br /> <br />Section, the City acknowledges the need for <br /> <br />records <br /> <br />confidentiality of <br /> <br />client <br /> <br />and <br /> <br />that <br /> <br />information <br /> <br />which <br /> <br />agrees <br /> <br />personally <br /> <br />iden ti fies <br /> <br />individual clients <br /> <br />will not be sought or required. <br /> <br />SECTION 7. <br /> <br />Sub-contracts. <br /> <br />No <br /> <br />part of <br /> <br />this <br /> <br />contract <br /> <br />may <br /> <br />be <br /> <br />--- <br /> <br />association <br /> <br />subcontracted to any other person, corporation, entity, organization or <br /> <br />wi thout <br /> <br />the <br /> <br />prior <br /> <br />written <br /> <br />consent <br /> <br />of the City to such <br /> <br />sub-contractor <br /> <br />and <br /> <br />the <br /> <br />to <br /> <br />terms <br /> <br />and <br /> <br />conditions of <br /> <br />any <br /> <br />such <br /> <br />sub-contract. <br /> <br />SF'.CTION <br /> <br />8. <br /> <br />No portion of the funds received <br /> <br />Political Activity. <br /> <br />by PHS under this contract shall be used, directly or <br /> <br />any <br /> <br />indirectly, <br /> <br />for <br /> <br />political <br /> <br />activity including any activity to further the election <br /> <br />or defeat of any candidate for public office or any activity undertaken <br /> <br />to influence <br /> <br />the <br /> <br />defeat or <br /> <br />fi na 1 <br /> <br />passage, <br /> <br />content of <br /> <br />legislation. <br /> <br />SECTION <br /> <br />9. <br /> <br />Compliance With Laws. <br /> <br />PHS agrees to comply with all <br /> <br />_.- <br /> <br />applicable laws, ordinances, codes and regulations of the local, <br /> <br />and <br /> <br />ordinances, <br /> <br />state <br /> <br />federal <br /> <br />including but <br /> <br />governments <br /> <br />limited to <br /> <br />not <br /> <br />those <br /> <br />laws, <br /> <br />codes <br /> <br />and <br /> <br />regulations <br /> <br />pertaining to <br /> <br />equal <br /> <br />employment <br /> <br />opportunity and those pertaining to discrimination against <br /> <br />participants. <br /> <br />SECTION 10. <br /> <br />Breach Of Contract. <br /> <br />A. <br /> <br />If the City determines that the activities as described in the <br />human services funding application attached hereto are not <br />being carried out as approved by the City or that PHS is <br />in breach of any of the terms of this agreement, the City <br />shall notify PHS in writing of the deficiency. PHS shall <br />have ten (10) working days from the date of the notice to <br />correct or satisfy the deficiency. <br /> <br />B. <br /> <br />If the deficiency is not appropriately corrected or satisfied <br />in the opinion of the City within the prescribed time, notice <br />may be given to PHS that its funding will be terminated. <br /> <br />C. <br /> <br />A decision to terminate funding may be appealed to the City's <br />Human Services Advisory Board within ten days of the date of <br />the notice to terminate funding. During the appeal process, <br />funding to PHS shall continue. <br /> <br />D. <br /> <br />The Human Services Advisory Board shall conduct a hearing <br />on the matter within ten (10) days of receipt of an appeal and <br />render a decision on the appeal as soon as practicable <br />thereafter. <br />
