<br /> <br /> <br /> <br />77 <br /> <br />ORDINANCE 1987 -135 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 17 OF THE SAN MARCOS <br />CODE OF ORDINANCES BY THE ADDITION OF SECTION 17-5, <br />SPECIAL EXPENSE FOR DEFENSI VE DRIVING AND REPEALING <br />SECTION 17-4, JURY FEES, AND DECLARING AN EMERGENCY. <br /> <br />BE <br /> <br />ORDAINED <br /> <br />BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That Section 17-5 of Chapter 17 of the San Marcos Code <br />of Ordinances is adopted to read as follows: <br /> <br />Se c. 1 7 - 5 . <br /> <br />Special Expense For Defensive Driving. <br /> <br />The municipal court clerk shall collect a special expense for <br />services performed in cases that are dismissed because the Court <br />is required by Art. 6701d, l43A, V.A.C.S., to dismiss the case <br />when the defendant completes a defensive driving course. The <br />special expense collected shall be equal to the actual expenses <br />incurred or $10.00, whichever is less. <br /> <br />SECTION 2. <br />is repealed. <br /> <br />That Section 17-4 of the San Marcos Code of Ordinances <br /> <br />SECTION 3. That the importance of this Ordinance creates an <br />emergency and an imperative public necessity so that the provisions of <br />the Charter requiring that ordinances shall be presented at three <br />separate meetings and that no ordinance shall become effective until <br />the expiration of ten (10) days following the date of its final passage <br />be suspended, and these provisions are hereby suspended, and this <br />Ordinance shall take effect and be in full force and effect from and <br />after its adoption and after its publication in a newspaper of general <br />circulation within the City as provied by the City Charter of the City <br />of San Marcos, Texas. <br /> <br />PASSED, APPROVED AND ADOPTED this <br /> <br /> <br />, 1987. <br /> <br />1 <br /> <br />October <br /> <br />~s~~ <br /> <br />Janis K. womac~ - <br />Ci ty Secretary <br /> <br />0=:- ~/ <br /> <br />Lamar W.
