<br />~ <br />~ <br /> <br /> <br />ORDINANCE 1987- 137 <br /> <br />79 <br /> <br /> <br />~ <br /> <br />..- <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 35, COMPREHENSIVE <br />DEVELOPMENT CODE OF THE SAN MARCOS CODE OF ORDINANCES <br />BY PROVIDING FOR VARIANCES AND APPEALS, CLARIFYING <br />BUFFERYARD REQUIREMENTS, ESTABLISHING THE NUMBER OF <br />REQUIRED DEED RESTRICTION COPIES, ESTABLISHING A <br />RECORDING FEE, CLARIFYING THE PDD PROCESS, ADDING APPENDIX <br />C, PLAN REQUIREMENTS, CLARIFYING THE DISCRETIONARY BONUS <br />AWARD PROCESS, ESTABLISHING BASE DENSITY, AND <br />ESTABLISHING AN EFFECTIVE DATE. <br /> <br />BE <br /> <br />IT <br /> <br />ORDAINED <br /> <br />BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. <br />follows: <br /> <br />That Section 700 of Chapter 35 is adopted to read as <br /> <br />Section 700. <br /> <br />Variances and Appeal <br /> <br />701. <br /> <br />Variances. <br /> <br />1. <br /> <br />Variances to the standards of this ordinance for PDD's <br />outside the City limits shall be made in accord with <br />Appendix C, Subdivisions, of the Code of Ordinances. <br /> <br />2. <br /> <br />Variances to the standards of this ordinance for PDD's <br />being zoned may be granted only by the City Council in <br />accord with the variance criteria in Appendix A, General <br />Zoning Ordinance, of the Code of Ordinances. <br /> <br />3. <br /> <br />Variances <br />granted. <br /> <br />to PDD decision-making procedures shall not <br /> <br />be <br /> <br />702. <br /> <br />Appeals. <br /> <br />Appeals of Planning Commission decisions on a PDD subdivision <br />outside the City limits or a City Council decision on PDD <br />zoning or discretionary bonuses may be made only to District <br />Court. <br /> <br />PART 2. That Section 700, Miscellaneous, and subsections 701 and <br />702 are renumbered as sections 800,801 and 802 respectively. <br /> <br />PART 3. <br />in its place: <br /> <br />That Section 307 <br /> <br />is repealed and the following adopted <br /> <br />307. <br /> <br />Bufferyard Plan and Platting Requirements. <br /> <br />1. <br /> <br />Bufferyards shall be platted as separate lots or as separate <br />easments and shall be accompanied by a bufferyard <br />maintenance plan. <br /> <br />2. <br /> <br />The bufferyard plan shall be submitted with the final plat, <br />in fifteen copies, be drawn to scale and include the <br />following information: <br /> <br />A. <br /> <br />location and type of existing vegetation, if any; <br /> <br />B. <br /> <br />general location and types of proposed canopy <br />understory trees, shrubs, and ground cover; <br /> <br />trees, <br /> <br />C. <br /> <br />location and <br />applicable; <br /> <br />type <br /> <br />of <br /> <br />wall <br /> <br />to <br /> <br />be <br /> <br />constructed, <br /> <br />if <br /> <br />D. <br /> <br />a description of how the bufferyard will be maintained <br />to include provision for adequate irrigation. <br /> <br />3. <br /> <br />The maintenance plan may be detailed on the bufferyard <br />or submitted separately in 15 copies. The maintenance <br />shall describe how the bufferyard will be established <br />maintained.
