TO THE AGREEMENT FOR <br />SO~D WASTE COLLECTION AND DISPOSAL <br />CITY OF SAN MARCOS, TEXAS <br /> <br />~VHEREAS, by execution of an Agreement on April 11,1983, the <br /> <br />City <br /> <br />of San Marcos, Texas (hereinafter referred to as "City") did enter into <br /> <br />a <br /> <br />contract <br /> <br />with <br /> <br />Browning-Ferris, <br /> <br />Inc. <br /> <br />(hereinafter <br /> <br />re ferred to as <br /> <br />"B.F.I.") <br /> <br />for solid waste collection and disposal within the City <br /> <br />and <br /> <br />such work as may be incidental thereto; now, therefore, <br /> <br />It <br /> <br />is <br /> <br />understood <br /> <br />and <br /> <br />ag reed <br /> <br />by <br /> <br />the <br /> <br />parties <br /> <br />hereto that the <br /> <br />following amendments are incorporated into <br /> <br />the <br /> <br />aforesaid <br /> <br />Ag reemen t. <br /> <br />1. <br /> <br />Any Consumer Price Index price increase which would become <br />due, per contract Section 13.02, Modification to Rates, on <br />August 1, 1988, is hereby waived. <br /> <br />2. <br /> <br />In the event B.F.I. participates in any resource recovery <br />program utilizing City.s solid wastes, or any portion thereof, <br />and thereby reduces its expenses incurred under this contract, <br />the fees charged by B.F.I. for services provided under this <br />contract shall be reduced proportionately. <br /> <br />3. <br /> <br />Section 3.01(d) of the contact is hereby <br />follows: <br /> <br />amended to <br /> <br />read <br /> <br />as <br /> <br />(d) Collection service to all City buildings, properties and <br />permanent activities, where needed, shall be furnished by <br />the contractor free o£ charge.
