BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, • <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation from "VLDR" Very Low Density Residential, <br />"LDR" Low Density Residential, and "OS" Open Space to "MU" Mixed Use, for the following <br />property: <br />Street address: West side of Hunter Road at the terminus of Foxtail and the south <br />side of Stagecoach at the terminus of Hunter's Hill Drive <br />Size: 101.40 acres, more or less <br />Legal Description and Deed Reference: J.M. Veramendi Survey No. 1, Abstract 17, <br />as further described in the attached Exhibit "A ". <br />SECTION 2. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to rezone the tract of real property described in <br />Section 1 above from "SF -6" Single - Family Residential District to "PDD" Planned Development <br />District with "MU" Mixed Use base zoning. <br />SECTION 3. The PDD Land Use Plan and the Development Standards for the Retreat on • <br />Willow Creek Planned Development District, as attached to this ordinance as Exhibit "B" are <br />approved and adopted to regulate the development of the Retreat on Willow Creek Planned <br />Development District site. Said Planned Development District site will be bound by the <br />provisions of the Land Use Plan and Development Standards as conditions, restrictions and <br />limitations on use of the Retreat on Willow Creek Planned Development District site under the <br />City's zoning ordinances provided, however, that the provisions of Section 4.3.1.2 of the Land <br />Development Code that would otherwise allow fraternity houses sorority houses boarding <br />houses, dormitories, and multifamily apartments in a Mixed Use zoning District with a <br />conditional use permit shall be inapplicable to this site. No portion of the site shall be used for <br />fraternity houses, sorority houses boarding houses dormitories or multifamily apartments land <br />uses without approval of a petition for a zoning map amendment by ordinance of the San Marcos <br />City Council. Any person, firm, corporation or other entity violating any provisions of the Land <br />Use Plan or the Development Standards shall be subject to all penalties that apply to violation of <br />the zoning ordinances of the City of San Marcos, as amended. Any person, firm, corporation or <br />other entity violating any provisions of the Land Use Plan or the Development Standards shall be <br />subject to a suit by the City for an injunction to enjoin the violation as though the Land Use Plan <br />and Development Standards were conditions, restrictions and limitations on use of said Willow <br />Creek Planned Development District site under the City's zoning ordinances. <br />SECTION 4. After its original passage, this ordinance will be subject to reconsideration <br />at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is <br />reconsidered and approved, it shall become effective ten days thereafter. • <br />
