<br />(5 ) <br /> <br />(6 ) <br /> <br />(7 ) <br /> <br />(8 ) <br /> <br />(9 ) <br /> <br />Contractor. Any individual, partnership, association, <br />or corporation engaged in the business of installing or <br />altering facilities within a public right-of-way. This <br />term shall apply to any entity which represents itself <br />to be engaged in this business, whether or not it is <br />actually doing the work. <br /> <br />Curb. A vertical or sloping structure located along <br />the edge of a roadway, normally constructed integrally <br />with the gutter, which strengthens and protects the <br />pavement edge and clearly defines the pavement edge to <br />vehicle operators. <br /> <br />Curb cut. An opening in a curb to allow the roadway <br />pavement to meet the pavement of a driveway approach or <br />an intersecting roadway, or, where no physical curb <br />exists, the length along the roadway edge where such <br />transitional pavement exists or is proposed. <br /> <br />Director of Public Works. The person who holds the <br />position of Director of the Public Works Division of <br />the City of San Marcos, or his/her designated repre- <br />sentative. <br /> <br />Drivewax approach. The transitional pavement between <br />the roadway and abutting property, installed in a curb <br />cut to provide vehicular access from the roadway to the <br />abutting property. <br /> <br />(10) Engineer. A person duly authorized under the <br />provisions of the Texas Engineering Registration Act, <br />as amended, to practice the profession of engineering. <br /> <br />(11) Gutter. <br />designed <br />roadway. <br /> <br />The <br />to <br /> <br />area of pavement adjacent to a curb, <br />transport stormwater runoff along a <br /> <br />(12) Inlet. An opening in a curb and/or gutter designed to <br />intercept stormwater runoff flowing along a gutter. <br /> <br />(13) Intersection. The publicly owned area between private <br />property lines designated as an easement for a roadway, <br />whether or not such roadway is actually installed. <br /> <br />(17) Roadway. That portion of the right-of-way designed and <br />ordinarily used for vehicular travel, usually surfaced <br />with a pavement. <br /> <br />(18) Shall/ma~. The word "shall" is always mandatory, while <br />the word "may. is merely permissive. <br /> <br />(19) Sidewalk. A paved pedestrian way generally located <br />within the public street right-of-way, but outside the <br />roadway, and built in accordance with City <br />specifications. <br /> <br />(20) Street: A public right-of-way which provides primary <br />vehicular access to adjacent land, whether designated <br />as a street, highway, thoroughfare, parkway, through- <br />way, avenue, lane, boulevard, road, place, drive or <br />however otherwise designated.
