147 'PP ORDINANCE 1987-150 -.;... AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ORDINANCE 1985-117 WHICH GRANTED SAID CITY'S CONSENT TO THE CREATION OF SAN MARCOS MUNICIPAL UTILITY DISTRICT NO.1 SUBJECT TO VARIOUS TERMS AND CONDITIONS CONTAINED IN A SEPARATE AGREEMENT MADE A PART OF SUCH ORDINANCE, BY APPROVING THE TERMS AND CONDITIONS OF ADDENDUM NO.1 TO SAID AGREEMENT SET FORTH IN ARTICLE XI THEREOF, AUTHORIZING THE MAYOR TO EXECUTE SAID ADDENDUM, AND DECLARING AN EMERGENCY. BE TEXAS: IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, SECTION 1. That Ordinance 1985-117 duly adopted on November 25, 1985, is hereby amended by approving the terms and conditions of Addendum No.1 to that agreement concerning Creation and Operation of San Marcos Municipal Utility District No.1 which was attached to and made a part of said Ordinance 1985-117, a copy of said Addendum No.1 being attached hereto and made a part hereof for all purposes, said Addendum amending Article XI of said Agreement to extend the time within which the said municipal utility district may be created by the Texas Water Commission to avoid automatic termination of said Agreement, from eighteen (18) months to twenty-four (24) months. SECTION 2. That the Mayor is hereby authorized to Addendum on behalf of said City. execute said SECTION 3. That the importance of this Ordinance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall be presented at three separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage be suspended, and these provisions are hereby suspended, and this Ordinance shall take effect and be in full force and effect from and after its adoption and after its publication in a newspaper of general circulation within the City as provided by the City Charter of the City of San Marcos.
