<br />148 <br /> <br />ADDENDUM NO.1 <br />TO SAN MARCOS MUNICIPAL UTILITY DISTRICT <br />NO.1 AGREEMENT <br /> <br />WHEREAS, <br /> <br />on <br /> <br />November <br /> <br />25, <br /> <br />1985, the City of San Marcos, Texas, <br /> <br />adopted Ordinance 1985-117 granting its consent to the creation of <br /> <br />San <br /> <br />Marcos <br /> <br />Municipal <br /> <br />Utility <br /> <br />District No.1 subject to various terms and <br /> <br />conditions <br /> <br />set <br /> <br />forth in <br /> <br />that <br /> <br />Agreement <br /> <br />Concerning <br /> <br />Creation <br /> <br />And <br /> <br />Operation Of San Marcos Municipal Utility District <br /> <br />No.1 <br /> <br />attached <br /> <br />to <br /> <br />and made a part of said ordinance; and, <br /> <br />WHEREAS, <br /> <br />the parties to said Agreement desire to amend Article XI <br /> <br />of the same to extend the time within which the said Municipal <br /> <br />Utility <br /> <br />District <br /> <br />may <br /> <br />be <br /> <br />created <br /> <br />by the Texas Water Commission from eighteen <br /> <br />(18) months to twenty-four (24) months; <br /> <br />NOW, THEREFORE, the parties hereto agree that <br /> <br />Article <br /> <br />XI of <br /> <br />the <br /> <br />above-referenced <br /> <br />Agreement is hereby amended to change the time within <br /> <br />which the said San Marcos <br /> <br />Municipal <br /> <br />Utility <br /> <br />District <br /> <br />No.1 <br /> <br />may <br /> <br />be <br /> <br />created <br /> <br />by <br /> <br />the <br /> <br />Texas <br /> <br />Water <br /> <br />Commission from eighteen (18) months to <br /> <br />twenty-four (24) months. <br /> <br />IN WITNESS WHEREOF, the parties hereto have caused this <br /> <br />Agreement <br /> <br />to be executed in triplicate originals as of the day and year evidenced <br /> <br />below. <br /> <br /> <br />AS TO FO~ <br /> <br />CITY OF SAN MARCOS, TEXAS <br /> <br />Lamar W.
