:::t- --:::.. <:::> -:;;:;: 12 ORDINANCE 1987-155 AN ORDIN'\HCE OR THE CITY carmCI L OF' THE CITY OF SAN MARCOS, TEXAS, AMENDING SUBSECTION (e) OF SECTTnN 11-11 OF CHAPTER 11 OF THE CODE OF ORDINANCES TO REQUIRE THE TRAINING OF ALL PROSPECTIVE HANDLERS OF FOOD WITHIN SAID CITY IN LIEU OF THE ACQUISITION OF HEALTH CERTIFICATES, AND DECLARING AN EFFECTIVE DATE. ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1: That subsection (e) of Section 11-11 of Chapter 11 of the Code of Ordinances of said City is hereby amended to read as follows: .:'1 (\! Chapter 11 Food And Food Establishments Sec. 11-11. Compliance procedures. (e) Food Handler Cards. (1) Required for employees. a. It shall be unlawful for any person to accept any person for employment in any food establishment, as that term is defined in this chapter, unless such person shall have obtained a valid food handler card. b. Notwithstanding the provisions of (a) above, the provisions of Article 4476-10, V.A.C.S., together with future am~~nts thereof, are adopted as a portion of this sectIon, insofar as applicable. (2) Completion of training session prerequisite to issuance. Any person required by this chapter to have a food handler card must first complete a 45-60 minute training session required by the San Marcos-Hays County Health Department. (3) Issuance; forms. Upon completion of the training session required by (2) above a food handler card may be issued which shall expire twenty-four (24) months from the date issued. The health officer is hereby authorized to adopt a form for the card, plan of registration and such other record keeping as will benefit the physicians and the San Marcos-Hays County Health Department. (4) Registration; record to be kept; charge. a. Each person receiving a food handler card shall, prior to reporting for work, go to the San Marcos-Hays County Health Department and have the card stamped and registered. It shall be the duty of the San Marcos-Hays County Health Department to retain a permanent record of all cards issued, to whom issued, the date issued and such other data as the health officer may deem proper. b. As an administrative charge for registering the card and performing other work involved, the San Marcos-Hays County Health Department shall make an administrative charge of eight dollars ($8.00). The San Marcos-Hays County Health Department shall make no charge for the administration of the training session. SECTION 2. This ordinance shall be in full force and effect January 1,1988 and from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
