<br /> <br /> <br /> <br />:::t- <br /> <br />--:::.. <br /><:::> <br />-:;;:;: <br /> <br />12 <br /> <br />ORDINANCE 1987-155 <br /> <br />AN ORDIN'\HCE OR THE CITY carmCI L OF' THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SUBSECTION (e) OF SECTTnN 11-11 <br />OF CHAPTER 11 OF THE CODE OF ORDINANCES TO REQUIRE THE <br />TRAINING OF ALL PROSPECTIVE HANDLERS OF FOOD WITHIN <br />SAID CITY IN LIEU OF THE ACQUISITION OF HEALTH <br />CERTIFICATES, AND DECLARING AN EFFECTIVE DATE. <br /> <br />ORDAINED <br /> <br />BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1: That subsection (e) of Section 11-11 of Chapter 11 of <br />the Code of Ordinances of said City is hereby amended to read as <br />follows: <br /> <br />.:'1 <br /> <br /> <br />(\! <br /> <br />Chapter 11 <br />Food And Food Establishments <br /> <br />Sec. 11-11. <br /> <br />Compliance procedures. <br /> <br />(e) Food Handler Cards. <br /> <br />(1) Required for employees. <br /> <br />a. <br /> <br />It shall be unlawful for any person to accept any <br />person for employment in any food establishment, as <br />that term is defined in this chapter, unless such <br />person shall have obtained a valid food handler card. <br /> <br />b. <br /> <br />Notwithstanding the provisions of (a) above, the <br />provisions of Article 4476-10, V.A.C.S., together with <br />future am~~nts thereof, are adopted as a portion of <br />this sectIon, insofar as applicable. <br /> <br />(2) Completion of training session prerequisite to issuance. <br />Any person required by this chapter to have a food handler <br />card must first complete a 45-60 minute training session <br />required by the San Marcos-Hays County Health Department. <br /> <br />(3) Issuance; forms. Upon completion of the training session <br />required by (2) above a food handler card may be issued <br />which shall expire twenty-four (24) months from the date <br />issued. The health officer is hereby authorized to adopt <br />a form for the card, plan of registration and such other <br />record keeping as will benefit the physicians and the San <br />Marcos-Hays County Health Department. <br /> <br />(4) Registration; record to be kept; charge. <br /> <br />a. <br /> <br />Each person receiving a food handler card shall, prior <br />to reporting for work, go to the San Marcos-Hays <br />County Health Department and have the card stamped and <br />registered. It shall be the duty of the San <br />Marcos-Hays County Health Department to retain a <br />permanent record of all cards issued, to whom issued, <br />the date issued and such other data as the health <br />officer may deem proper. <br /> <br />b. <br /> <br />As an administrative charge for registering the card <br />and performing other work involved, the San <br />Marcos-Hays County Health Department shall make an <br />administrative charge of eight dollars ($8.00). The San <br />Marcos-Hays County Health Department shall make no <br />charge for the administration of the training session. <br /> <br />SECTION 2. This ordinance shall be in full force and effect <br />January 1,1988 and from and after its passage, and it shall be <br />published in a newspaper of general circulation in the area as required <br />by the Charter of the City of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading <br /> <br />November 9, 1987. <br /> <br />PASSED AND APPROVED on second reading <br /> <br />November 23, 1987. <br />
