<br />fees, and all other expenses-incurred by the OWNER arising in favor of <br /> <br />any party, <br /> <br />including the amounts of any damages or awards resulting <br /> <br />from claims, demands and causes of action for personal injuries, death <br /> <br />or damages to property and without limitation by enumeration, all other <br /> <br />claims, <br /> <br />demands, <br /> <br />or causes of action of every character occurring, <br /> <br />resulting, or arising from any negligent or intentional wrongful act, <br />error or omission of the ARCHITECT and/or its agents and/or employees <br /> <br />and/or the joint negligence or joint intentional wrongful act, error, <br /> <br />omission of owner and ARCHITECT and/or its agents and/or employees. <br />Said indemnity and hold harmless provision shall not be limited by <br /> <br />reason of the specification of any particular insurance coverage in <br /> <br />this <br /> <br />Agreement. <br /> <br />ARCHITECT" <br /> <br />further <br /> <br />agrees <br /> <br />to <br /> <br />obtain <br /> <br />from <br /> <br />its <br /> <br />contractors, <br /> <br />subcontractors <br /> <br />and <br /> <br />consultants, <br /> <br />if <br /> <br />any, <br /> <br />the <br /> <br />same <br /> <br />indemnification and hold harmless provision in writing of OWNER as <br />stated hereinabove. <br /> <br />9.5 <br /> <br />The ARCHITECT agrees to procure and maintain at ARCHITECT's <br /> <br />expense until final payment by the OWNER for services covered by this <br />~greement, insurance in the kinds and amounts hereinafter provided with <br /> <br />insurance companies authorized to do business in the State of Texas, <br /> <br />covering all operations under this Agreement, <br /> <br />whether performed by <br /> <br />ARCHITECT or ARCHITECT's agents or employees. <br /> <br />Before commencing the <br /> <br />Work <br /> <br />the <br /> <br />ARCHITECT <br /> <br />shall <br /> <br />furnish <br /> <br />to <br /> <br />the <br /> <br />OWNER <br /> <br />a <br /> <br />certificate <br /> <br />or <br /> <br />certificates in form satisfactory to the OWNER, showing that ARCHITECT <br /> <br />has complied with this paragraph. <br /> <br />All certificates shall provide that <br /> <br />the policy shall not be changed or cancelled until at least thirty (30) <br /> <br />days' written notice shall have been given to the OWNER. <br /> <br />Kinds and <br /> <br />amounts of insurance required are as follows: <br /> <br />Workmen's <br /> <br />Compensation <br /> <br />Insurance: <br /> <br />Workmen's <br /> <br />Compensation <br /> <br />Insurance for ARCHITECT's employees in accordance with the provisions <br /> <br />)f the Workmen's Compensation Act of the State of Texas. <br /> <br />Liability <br /> <br />":nsurance: <br /> <br />Automobile liability <br /> <br />insurance <br /> <br />in <br /> <br />an amount not less <br /> <br />than $250,000 for injuries to anyone person and $500,000 on account of <br />anyone accident and in an amount of not less than $100,000 for <br /> <br />-16- <br />
