<br />authori ty to require special <br /> <br />inspection or testing of the Work in <br /> <br />accordance with the provisions of the construction contract documents, <br /> <br />whether or not such Work be then fabricated, installed or completed. <br /> <br />The ARCHITECT shall monitor and review the work and results of all <br /> <br />testing laboratories as required by OWNER. <br /> <br />1. 5 . 10 <br /> <br />The ARCHITECT shall review and make all decisions regarding <br /> <br />the approval or taking of other appropriate action upon the <br />Contractor's submittals, including but not limited to, Shop Drawings, <br />Product Data and Samples, Schedule of Values and progress schedule. <br /> <br />Such action shall be taken with reasonable promptness, but generally <br /> <br />not to exceed fifteen (15) days or such period of time which will not <br />cause delay of the project(s). <br /> <br />1. 5 .11 <br /> <br />The ARCHITECT shall prepare Change Orders for the OWNER's <br /> <br />approval and execution in accordance wi th the construction contract <br /> <br />documents, but shall not issue change orders not previously approved in <br />writing by OWNER, and no course of conduct on the part of ARCHITECT or <br /> <br />OWNER shall act to amend, waive or alter this provision. <br /> <br />If additive <br /> <br />~hange <br /> <br />Orders <br /> <br />are <br /> <br />required <br /> <br />as <br /> <br />a <br /> <br />result <br /> <br />of <br /> <br />any <br /> <br />error(s) <br /> <br />and/or <br /> <br />omission(s) <br /> <br />of ARCHITECT <br /> <br />as <br /> <br />determined by OWNER, <br /> <br />ARCHITECT <br /> <br />shall, <br /> <br />within thirty (30) days of receipt of an invoice therefor from OWNER, <br />reimburse OWNER in an amount equal to ten percent (10%) of the amount <br /> <br />of the additive change order. <br /> <br />1. 5 . 12 <br /> <br />The <br /> <br />ARCHITECT <br /> <br />shall <br /> <br />conduct <br /> <br />professional <br /> <br />inspections <br /> <br />to <br /> <br />determine the Dates of Substantial Completion and final completion, to <br /> <br />evaluate the Work for acceptable conformance wi th the construction <br /> <br />contract documents and in light of any subsequent tests performed as <br />described in Section 1.5.8 hereof, to verify that any minor deviations <br /> <br />from the construction contract documents as described in Section 1.5.8 <br /> <br />hereof have been corrected <br /> <br />and that the reasons <br /> <br />for any specific <br /> <br />:ualifications in any and all previous Certificates For Payment as <br />",escribed in Section 1. 5.8 hereof are either no longer valid or the <br /> <br />condition(s) and/or problem(s) have been corrected; shall receive and <br /> <br />review <br /> <br />written <br /> <br />warranties <br /> <br />and <br /> <br />related <br /> <br />documents <br /> <br />required <br /> <br />by <br /> <br />the <br /> <br />construction contract documents and assembled by the Contractor; <br /> <br />shall <br /> <br />-7- <br />
