BE 26 ORDINANCE 1987-158 AN ORf)HIANC~ OF THE CITY COUNCI L OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 2-43 OF DIVISION 2, ENTITLED "TEXAS MUNICIPAL RETIREMENT SYSTEM" OF ARTICLE III, ENTITLED "CIVIL SERVICE AND EMPLOYEE BENEFITS" OF CHAPTER 2 OF THE CODE OF ORDINANCES OF SAID CITY TO CHANGE THE DATE ON WHICH CALCULATIONS OF UPDATED SERVICE CREDITS ARE BASED UNDER THE ACT GOVERNING THE TEXAS MUNICIPAL RETIREMENT SYSTEM FOR SERVICE PERFORMED BY QUALIFYING MEMBERS OF SUCH SYSTEM IN THE EMPLOYMENT OF SAID CITY AND TO CHANGE THE DATE ON WHICH CALCULATIONS OF UPDATED SERVICE CREDITS ARE BASED UNDER SAID ACT FOR SERVICE PERFORMED BY QUALIFYING MEMBERS OF SUCH SYSTEM WHO HAVE UNFORFEITED CREDIT FOR PRIOR SERVICE AND/OR CURRENT SERVICE WITH OTHER PARTICIPATING MUNICIPALITIES BY REASON OF PREVIOUS SERVICE AND WHO WERE CONTRIBUTING MEMBERS ON JANUARY 1,1987; AMENDING SECTION 2-44(b) OF SAID DIVISION OF SAID ARTICLE OF SAID CHAPTER OF SAID CODE TO CHANGE THE DATE ON WHICH CALCULATIONS OF THE INCREASE IN RETIREMENT ANNUITIES ARE BASED; AND DECLARING AN EMERGENCY. IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 2-43 of Division 2 of Article III of Chapter 2 of the Code of Ordinances of the City of San Marcos, Texas, is hereby amended to change the date of January 1, 1987, in subsection (a) thereof to January 1,1988 and January 1,1986 in subsection (b) thereof to January 1, 1987. SECTION 2. That Section 2-44(b) of Division 2 of Article III of Chapter 2 of the Code of Ordinances of the City of San Marcos, Texas, is hereby amended to change the date of January 1, 1987 therein to January 1, 1988. SECTION 3. That the importance of this Ordinance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall be presented at three separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage be suspended, and these provisions are hereby suspended, and this Ordinance shall take effect and be in full force and effect from and after its adoption and after its publication in a newspaper of general circulation within the City as provided by the City Charter of the City of San Marcos, Texas. 16 PASSED, APPROVED AND ADOPTED this day of December, 1987. ê!1- . ~~1 t : v ).~/:1'1 /: J IA/YLt'¡' -U}. ¿/([)'ÎV'~ J is K.
