<br /> <br />~ <br /> <br /> <br />28 <br /> <br />ORDINANCE 1987-160 <br /> <br />'7 <br /><::) <br />'"2 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 33 OF THE SAN MARCOS <br />CODE OF ORDINANCES BY CHANGING ALL REFERENCES TO <br />SUSPENSION FROM THE WRECKER ROTATION SYSTEM FROM SIX <br />MONTHS TO THIRTY DAYS, AND ESTABLISHING AN EFFECTIVE <br />DATE. <br /> <br />BE <br />TEXAS: <br /> <br />IT <br /> <br />ORDAINED <br /> <br />BY <br /> <br />THE <br /> <br />CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> <br />SECTION 1. That Section 33-5 of Chapter 33 of the San Marcos Code <br />of Ordinances is amended to read as follows: <br /> <br />Sec. 33-5. <br /> <br />Availability. <br /> <br />. . . <br /> <br />If a wrecker or towing service fails to respond to a call on <br />three (3) occasions during a six-month period or on two (2) <br />occasions during a three month period, said service shall be <br />removed from the rotation for a period not to exceed thirty (30) <br />days. <br /> <br />SECTION 2. That Section 33-9(c) of Chapter 33 of the <br />Code of Ordinances is amended to read as follows: <br /> <br />San <br /> <br />Marcos <br /> <br />Sec. 33-9. <br /> <br />Insurance. <br /> <br />(c)...Penalty for failure to comply with this subsection shall <br />be removal from the rotation system for a period not to <br />exceed thirty (30) days. <br /> <br />SECTION 3. That Section 33-10 of <br />Ordinances is amended to read as follows: <br /> <br />Chapter <br /> <br />33 of the Code of <br /> <br />Sec. <br /> <br />33.10. <br /> <br />Prompt release of impounded vehicles. <br /> <br />...Failure to comply with this Section will result in removal <br />by the Chief of Police from the rotation system for a period <br />not to exceed thirty (30) days. <br /> <br />SECTION 4. That this Ordinance shall be in effect ten (10) days <br />from and after its passage, and it shall be published in a newspaper of <br />general circulation in the area as required by the Charter of the City <br />of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading <br /> <br />November 23, 1987. <br /> <br />PASSED AND APPROVED on second reading <br /> <br />December 7, 1987. <br /> <br />PASSED, APPROVED AND ADOPTED <br /> <br />, "', <br /> <br />Y1t5~ ß/~ <br /> <br />VZ ils K.
