<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, CANVASSING RETURNS AND
<br />DECLARING RESULTS OF THE REGULAR ELECTION HELD
<br />ON APRIL 4, 1987 FOR THE PURPOSE OF ELECTING A
<br />CITY COUNCIL MEMBER, PLACE THREE, AND A CITY
<br />COUNCIL MEMBER, PLACE FOUR, AND DECLARING AN
<br />El'1ERGENCY.

<br />WHEREAS, the City Council of the City of San l'1arcos, Texas,
<br />by ordinance duly enacted on January 12, 1987, ordered that a
<br />regular election be held on April 4, 1987 for the purpose of
<br />electing a city council member, place three and a city council
<br />member, place four; and,
<br />
<br />WHEREAS, notice of said election was duly publ ished in the
<br />San Marcos News on March 12 and 19, 1987; and,
<br />
<br />WHEREAS, copies of said notice were duly posted at each city
<br />election precinct polling place prior to said election, and a copy
<br />of same was posted on the bulletin board at City Hall on February
<br />27, 1987; and,
<br />
<br />WHEREAS, said election was duly and legally held on the 4th
<br />day of April, 1987, in conformity with the election laws of the
<br />State of Texas, and the results of said election have been
<br />certified and returned by the proper judges and clerks thereof;
<br />and,
<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas,
<br />with the following members present: J.E. Younger, Karl W. Brown,
<br />Bill Coddington, Gerald G. Farr, Fred Guerra and Betty Jane
<br />Kissler has today considered the returns of said regular election
<br />held on the 4th day of April, 1987; and,
<br />
<br />WHEREAS, it appears to the Council, and the Council so finds,
<br />that the said election was in all respects lawfully held; and,
<br />
<br />WHEREAS, it appears to the Council, and the Council so finds,
<br />that the tabulation of the results of said election is correct;
<br />now, therefore,
<br />
<br />BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the regular City election of April 4,
<br />1987 was duly called, that notice of said elec-tion was given in
<br />accordance with law, and that said election was held in accordance
<br />with law.
<br />
<br />SEc'rION 2. That the tabulation of votes cast in the
<br />regular election held on April 4, 1987 for the purpose of electing
<br />a city council member, place three and a city council member,
<br />place four, made and certified to by the City Secretary of the
<br />City of San Marcos, a copy of which is attached hereto and made a
<br />part hereof, be, and the same is hereby, adopted as the official
<br />tabulation of the votes cast at said election and that said
<br />tabulation be filed and recorded in the official records of the
<br />City of San Marcos as the official canvass of said election.
<br />
<br />SECTION 3. That the said official canvass of the returns
<br />of said election reflects the following:

<br />election reflects that no person received a majority of
<br />the votes for City Council Member, Place Three, of the
<br />City of San Marcos:
<br />
<br />Bill Coddington received 993 votes.
<br />Rick Hernandez received 993 votes.
