Regular Meeting <br /> <br />December 8, 2003 <br /> <br /> 110. <br />Page 3 <br /> <br />answer any questions. Mayor Habingreither asked if anyone else wished to <br />speak. No one did, so Mayor Habingreither closed the public hearing. <br />Ms. Narvaiz moved for adoption of the Zoning Ordinance and Mr. Taylor <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.26 ACRE <br />TRACT OF PROPERTY LOCATED AT 1403 W. HOPKINS STREET, FROM UR-l" <br />SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) TO ~TH-2" TOWNHOUSE <br />RESIDENTIAL DISTRICT (MEDIUM DENSITY); INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished <br />to speak. 1) Marcos Hernandez encouraged the Council to oppose this zoning <br />request. He stated this property would need to be accessed from Olive <br />Street, which is too narrow. He stated the only other access would be a <br />gravel alleyway, which is owned by the City. 2) W.C. Daniels stated he is <br />the developer of this property. He stated the plan for this property is <br />to be used by Tangram. He also stated most patients cannot drive, which <br />would not create any additional traffic. Mayor Habingreither asked if <br />anyone else wished to speak. No one did, so Mayor Habingreither closed <br />the public hearing. Ms. Narvaiz moved for adoption of the Zoning <br />Ordinance and Mr. Taylor seconded the motion. Mr. Thomaides stated he is <br />concerned with giving up R-1 Zoning. Mr. Thomaides inquired whether this <br />project would be similar to the Hutchison Street project. Mr. Daniels <br />stated the two projects would be similar. Mayor Habingreither inquired as <br />to the discussion the Planning and Zoning Commission had regarding this <br />request. Carrol Barrett, Director of Planning and Development, stated the <br />Planning and Zoning Commission held the same discussion. She stated the <br />access on Hopkins Street would be addressed in the site plans. Ms. <br />Narvaiz inquired as to the parking increase. Ms. Barrett stated for group <br />homes there are at least 4 parked cars per unit. Mr. Mihalkanin stated he <br />is concerned with taking away R-1 Zoning since it is so scarce. On roll <br />call the following vote was recorded: <br /> <br />AYE: <br /> <br />Thomaides, Habingreither, Taylor and Diaz. <br /> <br />NAY: <br /> <br />Narvaiz, Mihalkanin and Montoya. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Pro Tem Montoya introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE 2003-2004 CITY BUDGET TO PROVIDE FUNDING FOR THE SESSOM <br />CREEK DIVERSION PROJECT; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br /> <br />
