Ms. Narvaiz moved for adoption of the Zoning Ordinance and Mr. Taylor seconded the motion, which passed unanimously. Mayor Habingreither introduced for consideration a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.26 ACRE TRACT OF PROPERTY LOCATED AT 1403 W. HOPKINS STREET, FROM UR-l" SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) TO ~TH-2" TOWNHOUSE RESIDENTIAL DISTRICT (MEDIUM DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mayor Habingreither opened the public hearing and asked if anyone wished to speak. 1) Marcos Hernandez encouraged the Council to oppose this zoning request. He stated this property would need to be accessed from Olive Street, which is too narrow. He stated the only other access would be a gravel alleyway, which is owned by the City. 2) W.C. Daniels stated he is the developer of this property. He stated the plan for this property is to be used by Tangram. He also stated most patients cannot drive, which would not create any additional traffic. Mayor Habingreither asked if anyone else wished to speak. No one did, so Mayor Habingreither closed the public hearing. Ms. Narvaiz moved for adoption of the Zoning Ordinance and Mr. Taylor seconded the motion. Mr. Thomaides stated he is concerned with giving up R-1 Zoning. Mr. Thomaides inquired whether this project would be similar to the Hutchison Street project. Mr. Daniels stated the two projects would be similar. Mayor Habingreither inquired as to the discussion the Planning and Zoning Commission had regarding this request. Carrol Barrett, Director of Planning and Development, stated the Planning and Zoning Commission held the same discussion. She stated the access on Hopkins Street would be addressed in the site plans. Ms. Narvaiz inquired as to the parking increase. Ms. Barrett stated for group homes there are at least 4 parked cars per unit. Mr. Mihalkanin stated he is concerned with taking away R-1 Zoning since it is so scarce. On roll call the following vote was recorded: AYE: Thomaides, Habingreither, Taylor and Diaz. NAY: Narvaiz, Mihalkanin and Montoya. ABSTAIN: None. Mayor Pro Tem Montoya introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE 2003-2004 CITY BUDGET TO PROVIDE FUNDING FOR THE SESSOM CREEK DIVERSION PROJECT; AND INCLUDING PROCEDURAL PROVISIONS.
